Synopsis As Introduced
Amends the Capital Development Board Act. Makes a technical change in a Section concerning the short title of the Act.

Deletes everything after the enacting clause. Amends the State Finance Act. Prohibits the granting of State funds for capital purposes unless the grantee has certified that he or she shall comply with the disadvantaged business practices of the Business Enterprise for Minorities, Females, and Persons with Disabilities Act and the equal employment practices of the Illinois Human Rights Act. Amends the Business Enterprise for Minorities, Females, and Persons with Disabilities Act. Requires that a business must be certified under the Act in order for a State agency to include the business in the State agency's goals under the Act. Requires the Business Enterprise Council to maintain an Internet database of waivers granted under the Act. Requires a State agency to give public notice of certain bid information when it gives public notice of the award of a contract. Requires any unit of local government with a similar program of goals and waivers to maintain such a database and publish such information.

Senate Floor Amendment No. 4
Deletes everything after the enacting clause. Amends the State Finance Act. Prohibits the granting of State funds for capital purposes unless the grantee has certified that he or she shall comply with the business enterprise program practices of the Business Enterprise for Minorities, Females, and Persons with Disabilities Act and the equal employment practices of the Illinois Human Rights Act. Requires that State grantees submit their business enterprise program plans with their grant agreements. Amends the Business Enterprise for Minorities, Females, and Persons with Disabilities Act. Requires each chief procurement officer to maintain an Internet database of waivers granted under the Act with respect to contracts under his or her jurisdiction. Requires a State agency to give public notice of certain bid information when it gives public notice of the award of a contract.

Senate Floor Amendment No. 5
Deletes everything after the enacting clause. Reinserts the provisions of Senate Amendment No. 4 with the following changes: In the State Finance Act, applies the provisions to the award by grant, contract, or capital agreement, and the line item appropriation, of State funds for construction, capital supplies, or capital services. Requires that each submitted business enterprise program plan apply only with respect to the State-funded portion of the relevant capital project and comply with the Business Enterprise for Minorities, Females, and Persons with Disabilities Act. Conditions disbursement of funds upon successful compliance with the submitted plan. Effective July 1, 2011.

Senate Floor Amendment No. 6
Deletes everything after the enacting clause. Reinserts the provisions of Senate Amendment No. 4 with the following changes: In the State Finance Act, applies the provisions to the award by grant, contract, or capital agreement, and the line item appropriation, of State funds of $250,000 or more for construction, capital supplies, or capital services. Requires that each submitted business enterprise program plan apply only with respect to the State-funded portion of the relevant capital project and comply with the Business Enterprise for Minorities, Females, and Persons with Disabilities Act. Conditions final disbursement of funds upon successful compliance with the submitted plan. Effective July 1, 2011.

House Committee Amendment No. 1
Replaces everything after the enacting clause with the engrossed bill with the following changes: In the State Finance Act, applies the certification requirement to grants and loans (instead of contracts, grants, capital agreements, and appropriations) for capital construction costs or professional services (instead of capital construction, capital supplies, or capital services). Requires that each recipient submit the written certification and the business program plan (instead of only the business program plan) before the signing of (instead of with) the grant or loan agreement. Exempts certain specified categories of grants and loans. Requires that each grant or loan agreement include a provision that the recipient agrees to comply with the Business Enterprise for Minorities, Females, and Persons with Disabilities Act and the equal employment practices of Section 2-105 of the Illinois Human Rights Act. In the Business Enterprise for Minorities, Females, and Persons with Disabilities Act, permits waivers at the request of a grant or loan recipient subject to the State Finance Act requirements. Changes the effective date to immediate (instead of July 1, 2011).
