Synopsis As Introduced
Amends the River Edge Redevelopment Zone Act. Provides that a public utility may receive a deduction against income subject to State taxes for (i) a contribution to a designated zone organization for costs of installing, replacing, modifying, removing, improving, or maintaining any substation facility located within the River Edge Redevelopment Zone or (ii) the costs incurred by the public utility of installing, replacing, modifying, improving, or maintaining any substation facility located within the River Edge Redevelopment Zone if the project for which the costs are incurred has been specifically approved by the designating municipality and by the Department of Commerce and Economic Opportunity. Provides that a public utility shall recover the costs of installing, replacing, modifying, improving, removing, or maintaining its facilities located within the River Edge Redevelopment Zone across all customers in its service territory. Contains other provisions. Effective immediately.

Deletes reference to:

Deletes everything after the enacting clause. Reinserts the introduced bill with changes. Removes provisions that provide that a public utility may receive a deduction against income subject to State taxes for (i) a contribution to a designated zone organization for costs of installing, replacing, modifying, removing, improving, or maintaining any substation facility located within the River Edge Redevelopment Zone or (ii) the costs incurred by the public utility of installing, replacing, modifying, improving, or maintaining any substation facility located within the River Edge Redevelopment Zone if the project for which the costs are incurred has been specifically approved by the designating municipality and by the Department of Commerce and Economic Opportunity. Effective immediately.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Amends the River Edge Redevelopment Zone Act. Provides that it is the policy of the State that the cost of supplying public utility services is allocated to those who cause the costs to be incurred. Provides that the policy requires an entity engaging in economic redevelopment to pay all costs to relocate utility facilities on property that the utility owns in areas that have been designated for economic redevelopment. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the River Edge Redevelopment Zone Act. Provides that a public utility that has facilities or land affected by the clean-up, remediation, and redevelopment of a River Edge Redevelopment Zone and that incurs costs related to the remediation or the removing or relocating of utility facilities in the River Edge Redevelopment Zone may recover the costs. Provides that the costs incurred by a public utility for facility removal or relocation shall be shared equally among the public utility, the municipality in which the facility is located, and specified landowners. Provides that the Illinois Commerce Commission shall allow a public utility to fully recover from all retail customers in its service territory all reasonable costs that it incurs in conducting environmental remediation in the River Edge Redevelopment Zone related to the removal or relocation of utility facilities in the River Edge Redevelopment Zone. Provides that the Section is repealed 7 years after the effective date of the amendatory Act. Contains other provisions. Effective immediately.

House Floor Amendment No. 2
Further amends the River Edge Redevelopment Zone Act. Provides that a public utility that has facilities or land affected by the clean-up, remediation, and redevelopment of a River Edge Redevelopment Zone and that incurs costs related to the remediation or the removing or relocating of utility facilities in the River Edge Redevelopment Zone may recover all "reasonable and prudent" costs. Provides that the Illinois Commerce Commission shall allow a public utility to fully recover from all retail customers in its service territory all reasonable "and prudent" costs that it incurs in conducting environmental remediation in the River Edge Redevelopment Zone related to the removal or relocation of utility facilities in the River Edge Redevelopment Zone.
