Synopsis As Introduced
Amends the Illinois Income Tax Act. Makes a technical change in a Section concerning the short title.

Senate Committee Amendment No. 1

Replaces everything after the enacting clause. Amends the Illinois Income Tax Act. Creates income tax credits for amounts invested by a taxpayer in a qualified new business venture, including investments made through an investment fund manager. Provides that the credit shall be equal to 25% of the amount invested. Provides that the credits may be carried forward for a period of 5 years. Provides that the credits are exempt from the Act's automatic sunset provisions. Provides that the Department of Commerce and Economic Opportunity shall certify the qualified business ventures and investment fund managers. Sets forth certain criteria for the certification of the business venture. Effective immediately.

Senate Committee Amendment No. 2
Provides that the Department of Commerce and Economic Opportunity, in consultation with the Department of Revenue, shall adopt rules to administer the angel investment credit. Provides that not more than $10,000,000 in angel investment credits may be issued per calendar year. Provides that a business may not be certified as a qualified business if it has received more than $2,000,000 (instead of $1,000,000) in qualified angel investments prior to certification. Provides that angel investment credits and early stage seed investment credits may be sold or transferred upon authorization of the Department of Commerce and Economic Opportunity and the Department of Revenue (now, early seed investment credits may be sold or transferred upon authorization of the investment fund manager). Makes other technical changes.

Replaces everything after the enacting clause. Amends the New Markets Development Program Act. Increases the annual cap on credits from $10,000,000 to $20,000,000. Amends the Illinois Income Tax Act. Creates a credit for taxable years beginning after December 31, 2010, and ending on or before December 31, 2016 in an amount equal to 25% of the claimant's investment made directly in a qualified new business venture. Sets forth criteria for qualified new business ventures. Provides that the Department of Commerce and Economic Opportunity must certify applicants for the credit and must register qualified new business ventures. Provides that the maximum amount of an applicant's investment that may be used as the basis for a credit under this Section is $2,000,000 for each investment made directly in a qualified new business venture. Requires the Department of Commerce and Economic Opportunity to report annually to the Governor and to the General Assembly on the tax credit certificates awarded under this Section for the prior calendar year. Some provisions effective July 1, 2010; other provisions effective January 1, 2011.
