    Amends the Illinois Plumbing License Law. Provides that, if a unit of local government regulates reclaimed water systems, then those reclaimed water systems must meet specific requirements. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Plumbing License Law is amended by
5 adding Section 35.5 as follows:
 
6     (225 ILCS 320/35.5 new)
7     Sec. 35.5. Reclaimed water recycling systems; exemption
8 for governmental units.
9     (a) For purposes of this Act, "reclaimed water" means a
10 combination of harvested storm (raw) water, domestic potable
11 water, and condensated water from air conditioning systems.
12     (b) If a unit of local government regulates reclaimed water
13 systems, then those reclaimed water systems must meet the
14 requirements of this Section.
15     (c) Reclaimed water systems must meet all of the following
16 requirements:
17         (1) All reclaimed water recycling systems must comply
18     with the provisions of the Illinois Plumbing Code, 77 Ill.
19     Adm. Code 890.
20         (2) Above-ground drain, waste, and vent piping for
21     reclaimed water systems must conform to accepted standards
22     listed in Table A of Appendix A of 77 Ill. Adm. Code 890.

1     pipe must conform to one of the standards listed in Table A
2     of Appendix A of 77 Ill. Adm. Code 890.
3         (3) The drain, waste, and vent piping for any reclaimed
4     water system must be tested in accordance with 77 Ill. Adm.
5     Code 890.1910.
6         (4) All reclaimed water systems must be inspected in
7     accordance with 77 Ill. Adm. Code 890.1910.
8         (5) Only connections in accordance with this Section
9     may be made between a reclaimed water system and a potable
10     water system.
11         (6) Reclaimed water systems must receive only the water
12     discharge of gutters, downspouts, roof drains, AC
13     condensate drains, and potable water system.
14         (7) Reclaimed water must be collected in a reservoir
15     constructed of durable, nonabsorbent, and
16     corrosion-resistant materials. The reservoir must be a
17     closed and vented vessel. Access openings must be provided
18     to allow inspection and cleaning of the reservoir interior.
19         (8) Harvested rain water entering the reservoir must
20     pass through an approved filter, such as a media, or mesh
21     screen.
22         (9) An air gap must be installed downstream of the
23     potable water fill line connection to the collection
24     reservoir.
25         (10) The collection reservoir must be equipped with an
26     overflow pipe having the same or larger diameter as the

1     influent pipe for the harvested storm water. The overflow
2     pipe must be indirectly connected to drainage swale or
3     storm sewer.
4         (11) The reservoir must be provided with a vent sized
5     in accordance with Department requirements and based on the
6     diameter of the reservoir influent pipe.
7     (d) Systems for flushing water closets and urinals must
8 meet all of the following requirements:
9         (1) The holding capacity of the reservoir must be a
10     minimum of twice the volume of water required to meet the
11     daily flushing requirements of the fixtures supplied with
12     reclaimed water, but not less than 50 gallons (189 Liters).
13         (2) Reclaimed water must be disinfected by a method
14     approved by the Department that employs one or more
15     disinfectants such as chlorine, iodine, or ozone.
16         (3) Potable water must be supplied as a source of
17     makeup water for the reclaimed water system. The potable
18     water supply must be protected against backflow in
19     accordance with 77 Ill. Adm. Code 890.1110.
20         (4) The reclaimed water must be dyed blue or green with
21     a food grade vegetable dye before such water is supplied to
22     the fixtures.
23         (5) Distribution piping must conform to one of the
24     standards listed in Table A of Appendix A of 77 Ill. Adm.
25     Code 890.
26         (6) Distribution piping and reservoirs must be

1     identified as containing non-potable water. Distribution
2     fittings to be identified with signs. Piping
3     identification must be in accordance with 77 Ill. Adm. Code
4     890.1120.
5     (e) Surface landscape irrigation systems must meet all of
6 the following requirements:
7         (1) Reservoirs must be sized to maintain a 2-day supply
8     of irrigation water.
9         (2) The reservoir must be identified as containing
10     non-potable water.
11         (3) A check valve and a full-open valve located on the
12     discharge side of the check valve must be installed on the
13     effluent pipe of the collections reservoir.
14         (4) Makeup water is not required for surface landscape
15     irrigation systems. Where makeup water is provided, the
16     installation must be in accordance with paragraph (3) of
17     subsection (d) of this Section.
18         (5) Disinfection is not required for reclaimed water
19     used for surface landscape irrigation systems.
20         (6) Reclaimed water used for surface landscape
21     irrigation systems is not required to be dyed.
22         (7) The system must be sized in accordance with
23     standards set by the Department.
24     (f) Nothing in this Act prohibits the State or any
25 governmental unit from installing and using a reclaimed water
26 recycling system, including systems for flushing of water

1 closets and urinals and surface landscape irrigation systems.
2 However, any reclaimed water recycling system must be in
3 accordance with the requirements of this Section.
 
4     Section 99. Effective date. This Act takes effect upon
5 becoming law.
