| 1 | AMENDMENT TO HOUSE BILL 277

| 2 | AMENDMENT NO. ______. Amend House Bill 277 on page 1, after | ||||||
| 3 | line 9, by inserting the following: | ||||||
| 4 | ""Healthcare facility" means an assisted living facility, | ||||||
| 5 | home health agency, hospice, physician practice, | ||||||
| 6 | rehabilitation facility, or long-term care facility."; and
| ||||||
| 7 | on page 2, line 5, by replacing "any person" with "a healthcare | ||||||
| 8 | facility"; and | ||||||
| 9 | on page 4, by replacing lines 1 through 15 with the following: | ||||||
| 10 | "Section 30. Immunity. A pharmacist or other health care | ||||||
| 11 | professional working in a pharmacy participating in the program | ||||||
| 12 | dispensing, furnishing, or otherwise providing in good faith | ||||||
| 13 | without fee or compensation donated prescription drugs to | ||||||
| 14 | eligible individuals under this Act shall not be subject to | ||||||
| 15 | professional or civil liability, except for willful or wanton | ||||||

| |||||||
| 1 | misconduct.".
