1 | AN ACT concerning professional regulation.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Dental Practice Act is amended by | ||||||
5 | changing Sections 9 and 13 as follows:
| ||||||
6 | (225 ILCS 25/9) (from Ch. 111, par. 2309)
| ||||||
7 | (Section scheduled to be repealed on January 1, 2016)
| ||||||
8 | Sec. 9. Qualifications of Applicants for Dental Licenses. | ||||||
9 | The
Department shall require that each applicant for a license | ||||||
10 | to
practice dentistry shall:
| ||||||
11 | (a) (Blank).
| ||||||
12 | (b) Be at least 21 years of age and of good moral | ||||||
13 | character.
| ||||||
14 | (c) (1) Present satisfactory evidence of completion of | ||||||
15 | dental
education by graduation from a dental college or school | ||||||
16 | in the United
States or Canada approved by the Department. The | ||||||
17 | Department shall not approve
any dental college or school which | ||||||
18 | does not require at least (A) 60 semester
hours of collegiate | ||||||
19 | credit or the equivalent in acceptable subjects from a
college | ||||||
20 | or university before admission, and (B) completion of at least | ||||||
21 | 4
academic years of instruction or the equivalent in an | ||||||
22 | approved dental college
or school before graduation; or
| ||||||
23 | (2) Present satisfactory evidence of completion of dental |

| |||||||
1 | education by
graduation from a dental college or school outside | ||||||
2 | the United States or
Canada and provide satisfactory evidence | ||||||
3 | that:
| ||||||
4 | (A) (blank);
| ||||||
5 | (B) the applicant has completed a minimum of 2 academic | ||||||
6 | years of general
dental clinical training at a dental | ||||||
7 | college or school in the United States or
Canada approved | ||||||
8 | by the Department, however, an accredited advanced dental | ||||||
9 | education program approved by the Department of no less | ||||||
10 | than 2 years may be substituted for the 2 academic years of | ||||||
11 | general dental clinical training and an applicant who was | ||||||
12 | enrolled
for not less than one year in an approved clinical | ||||||
13 | program prior to January 1,
1993 at an Illinois dental | ||||||
14 | college or school shall be required to complete only
that | ||||||
15 | program; and
| ||||||
16 | (C) the applicant has received certification from the | ||||||
17 | dean of an
approved dental college or school in the United | ||||||
18 | States or Canada or the program director of an approved | ||||||
19 | advanced dental education program stating that
the | ||||||
20 | applicant has achieved the same level of scientific | ||||||
21 | knowledge and clinical
competence as required of all | ||||||
22 | graduates of the college, school, or advanced dental | ||||||
23 | education program.

24 | Nothing in this Act shall be construed to prevent either | ||||||
25 | the Department or
any dental college or school from | ||||||
26 | establishing higher standards than
specified in this Act.

1 | (d) In determining professional capacity under this | ||||||
2 | Section, any
individual who has not been actively engaged in | ||||||
3 | the practice of dentistry,
has not been a dental student, or | ||||||
4 | has not been engaged in a formal program
of dental education | ||||||
5 | during the 5 years immediately preceding the filing of an
| ||||||
6 | application may be required to complete such additional | ||||||
7 | testing, training, or
remedial education as the Board may deem | ||||||
8 | necessary in order to establish
the applicant's present | ||||||
9 | capacity to practice dentistry with reasonable
judgment, | ||||||
10 | skill, and safety.
| ||||||
11 | (e) Present satisfactory evidence that the applicant has | ||||||
12 | passed both parts of the National Board Dental Examination | ||||||
13 | administered by the Joint Commission on National Dental | ||||||
14 | Examinations and has successfully completed an examination | ||||||
15 | conducted by one of the following regional testing services: | ||||||
16 | the Central Regional Dental Testing Service, Inc. (CRDTS), the | ||||||
17 | Southern Regional Testing Agency, Inc. (SRTA), the Western | ||||||
18 | Regional Examining Board (WREB), or the North East Regional | ||||||
19 | Board (NERB). For purposes of this Section, successful | ||||||
20 | completion shall mean that the applicant has achieved a minimum | ||||||
21 | passing score as determined by the applicable regional testing | ||||||
22 | service. | ||||||
23 | (f) The Secretary of the Department may suspend a regional | ||||||
24 | testing service under subsection (e) of this Section if, after | ||||||
25 | proper notice and hearing, it is established that (i) the | ||||||
26 | integrity of the examination has been breached so as to make |

1 | future test results unreliable or (ii) the test is | ||||||
2 | fundamentally deficient in testing clinical competency. Pass | ||||||
3 | an examination authorized or given by the Department
in the | ||||||
4 | theory and practice of the science of dentistry; provided,
that | ||||||
5 | the Department (1) may recognize a certificate granted by the | ||||||
6 | National
Board of Dental Examiners in lieu of, or subject to, | ||||||
7 | such examination as
may be required and (2) may recognize | ||||||
8 | successful completion of the clinical examination conducted by | ||||||
9 | approved regional testing services in
lieu of such examinations | ||||||
10 | as may be required. For purposes of this Section,
successful | ||||||
11 | completion shall mean that the applicant has achieved a minimum
| ||||||
12 | passing score on the regional examinations as determined by | ||||||
13 | each approved
regional testing service.

17 | Sec. 13. Qualifications of Applicants for Dental | ||||||
18 | Hygienists. Every
person who desires to obtain a license as a | ||||||
19 | dental hygienist shall apply to the
Department in writing, upon | ||||||
20 | forms prepared
and furnished by the Department. Each | ||||||
21 | application shall contain proof of
the particular | ||||||
22 | qualifications required of the applicant, shall be verified
by | ||||||
23 | the applicant, under oath, and shall be accompanied by the | ||||||
24 | required
examination fee.

25 | The Department shall require that every applicant for a |
| |||||||
| |||||||
1 | license
as a dental hygienist shall:
| ||||||
2 | (1) (Blank).
| ||||||
3 | (2) Be a graduate of high school
or its equivalent.
| ||||||
4 | (3) Present satisfactory evidence of having successfully | ||||||
5 | completed 2 academic
years of credit at a dental hygiene | ||||||
6 | program accredited by the Commission on
Dental Accreditation of | ||||||
7 | the American Dental Association.
| ||||||
8 | (4) Submit evidence that he holds a currently valid | ||||||
9 | certification to
perform cardiopulmonary resuscitation. The | ||||||
10 | Department shall adopt rules
establishing criteria for | ||||||
11 | certification in cardiopulmonary resuscitation.
The rules of | ||||||
12 | the Department shall provide for variances only in instances
| ||||||
13 | where the applicant is physically disabled and therefore unable | ||||||
14 | to secure
such certification.

15 | (5) (Blank).
| ||||||
16 | (6) Present satisfactory evidence that the applicant has | ||||||
17 | passed the National Board Dental Hygiene Examination | ||||||
18 | administered by the Joint Commission on National Dental | ||||||
19 | Examinations and has successfully completed an examination | ||||||
20 | conducted by one of the following regional testing services: | ||||||
21 | the Central Regional Dental Testing Service, Inc. (CRDTS), the | ||||||
22 | Southern Regional Testing Agency, Inc. (SRTA), the Western | ||||||
23 | Regional Examining Board (WREB), or the North East Regional | ||||||

6 | in testing clinical competency. Pass an examination authorized | ||||||
7 | or given by the Department in the
subjects usually taught in | ||||||
8 | approved programs of dental hygiene, which
examination shall | ||||||
9 | determine the qualifications of applicants to perform the
| ||||||
10 | operative procedures of dental hygiene. The Department may | ||||||
11 | recognize a
certificate granted by the National Board of Dental | ||||||
12 | Examiners in lieu of,
or subject to, such examination.

14 | Section 99. Effective date. This Act takes effect upon | ||||||
15 | becoming law.
