| in which he or
she is a resident for purposes of physician |

in-patient admission to a hospital, the |

| Department's rules shall, at a minimum,
provide (1) bed reserve |

| payments at a daily rate which is 100%
of the client's current |

| per diem rate, for a period not exceeding 10 consecutive days; |
6 |
| (2) bed reserve payments at a
daily rate which is 75% of a |
7 |
| client's current per diem rate, for a period
which exceeds 10 |
8 |
| consecutive days but does not exceed 30 consecutive days; and |
9 |
| (3) bed reserve payments at a daily rate which
is 50% of a |
10 |
| client's current per diem rate for a period which exceeds |
11 |
| thirty
consecutive days but does not exceed 45 consecutive |
12 |
| days.

| (b) When a resident of an Intermediate Care Facility for |
14 |
| the
Developmentally Disabled (ICF/DD) is absent from the ICF/DD |
15 |
| in which he or
she is a resident for purposes of a home visit |
16 |
| with a family
member the Department's rules shall, at a |
17 |
| minimum, provide (1) bed reserve
payments at a rate which is |
18 |
| 100% of a client's current per diem rate, for a
period not |
19 |
| exceeding 10 days per State fiscal year; and (2) bed
reserve |
20 |
| payments at a rate which is 75% of a client's current per diem |
21 |
| rate,
for a period which exceeds 10 days per State fiscal year |
22 |
| but does
not exceed 30 days per State fiscal year.

| (c) No Department rule regarding bed reserve payments shall |
24 |
| require an
ICF/DD to have a specified percentage of total |
25 |
| facility occupancy as a
requirement for receiving bed reserve |
26 |
| payments.
