1 | AMENDMENT TO HOUSE BILL 699

2 | AMENDMENT NO. ______. Amend House Bill 699 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Criminal Code of 1961 is amended by | ||||||
5 | changing Section 12-4.1 as follows:
| ||||||
6 | (720 ILCS 5/12-4.1) (from Ch. 38, par. 12-4.1)
| ||||||
7 | Sec. 12-4.1. Heinous Battery.
| ||||||
8 | (a) A person who, in
committing a battery, knowingly causes | ||||||
9 | severe and permanent
disability, great bodily harm or | ||||||
10 | disfigurement by means of a caustic or
flammable substance,
a | ||||||
11 | poisonous gas, a deadly biological or chemical contaminant or
| ||||||
12 | agent, a
radioactive substance, or a bomb or explosive | ||||||
13 | compound , or any other dangerous weapon as defined by Section | ||||||
14 | 33A-1 of this Code
commits heinous battery.
| ||||||
15 | (b) Sentence. Heinous battery is a Class X felony for which | ||||||
16 | a person shall
be sentenced to a term of imprisonment of no |
| |||||||
| |||||||
1 | less than 6 years and no more
than 45 years.
