| AN ACT concerning public aid.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Public Aid Code is amended by |
| 5 |
| adding Section 11-4.1 as follows:
|

| (305 ILCS 5/11-4.1 new) |
| 7 |
| Sec. 11-4.1. Medical providers assisting with |
| 8 |
| applications for medical assistance. A provider enrolled to |
| 9 |
| provide medical assistance services may, upon the request of an |
| 10 |
| individual, accompany, represent, and assist the individual in |
| 11 |
| applying for medical assistance under Article V of this Code. |
| 12 |
| If an individual is unable to request such assistance due to |
| 13 |
| incapacity or mental incompetence and has no other |
| 14 |
| representative willing or able to assist in the application |
| 15 |
| process, a facility licensed under the Nursing Home Care Act or |
| 16 |
| the MR/DD Community Care Act or certified under this Code is |
| 17 |
| authorized to assist the individual in applying for long-term |
| 18 |
| care services. Subject to the provisions of the Free Healthcare |
| 19 |
| Benefits Application Assistance Act, nothing in this Section |
| 20 |
| shall be construed as prohibiting any individual or entity from |
| 21 |
| assisting another individual in applying for medical |
| 22 |
| assistance under Article V of this Code.
