| AMENDMENT NO. ______. Amend House Bill 927 as follows:

| on page 3, line 9, after "plan.", by inserting "Individuals |

| unable to participate in these incentives due to an adverse |
| 5 |
| health factor shall not be penalized based upon an adverse |
| 6 |
| health status."; and
|
| 7 |
| on page 3, immediately below line 15, by inserting the |
| 8 |
| following: |

| "For the purposes of this Section, "reasonably designed |
| 10 |
| program" means a program of wellness coverage that has a |
| 11 |
| reasonable chance of improving health or preventing disease; is |
| 12 |
| not overly burdensome; does not discriminate based upon factors |
| 13 |
| of health; and is not otherwise contrary to law."; and
