| AMENDMENT NO. ______. Amend House Bill 1042 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Green Governments Illinois Act is amended |
5 |
| by changing Sections 15, 20, and 35 as follows: |
6 |

| Sec. 15. Composition of the Council. The Council shall be |
8 |
| comprised of representatives from various State agencies and |
9 |
| State universities with specific fiscal, procurement, |
10 |
| educational, and environmental policy expertise. The |
11 |
| Lieutenant Governor is the chair of the Council. The director |
12 |
| or President, respectively, of each of the following State |
13 |
| agencies and State universities, or his or her designee, is a |
14 |
| member of the Council: the Department of Commerce and Economic |
15 |
| Opportunity, the Environmental Protection Agency, the |
16 |
| University of Illinois , ; the Department of Natural Resources, , |

| the Department of Central Management Services, the Governor's |
2 |
| Office of Management and Budget, the Department of Agriculture, |
3 |
| the Department of Transportation, the Department of |
4 |
| Corrections, the Department of Human Services, the Department |
5 |
| of Public Health, the State Board of Education, the Board of |
6 |
| Higher Education, and the Capital Development Board. The Office |
7 |
| of the Lieutenant Governor shall provide administrative |
8 |
| support to the Council. A minimum of one staff position in the |
9 |
| Office of the Lieutenant Governor shall be dedicated to the |
10 |
| Green Governments Illinois program.

| Sec. 20. Responsibilities of the Council. The Council is |
15 |
| responsible for the development and dissemination of programs, |
16 |
| plans, and policies to reduce the environmental footprint of |
17 |
| State government and for improving the implementation of |
18 |
| greening the government initiatives in other institutions, |
19 |
| thereby reducing costs to taxpayers and improving efficiency in |
20 |
| operations. The Council shall convene on a quarterly basis and |
21 |
| shall be responsible for the following: |
22 |
| (a) Establishing long-term environmental |
23 |
| sustainability goals that the State will strive to achieve |
24 |
| within a period of 3, 5, and 10 years to improve the energy |
25 |
| and environmental performance of State buildings, |

| consistent with efficiency and economic objectives. These |
2 |
| goals shall, at a minimum, include the following: |
3 |
| broad-based performance goals for energy efficiency; use |
4 |
| of renewable fuels; water conservation; green purchasing; |
5 |
| paper consumption; and solid waste generation. These goals |
6 |
| can be met through increased efficiency, operational |
7 |
| changes, and improved maintenance and use of |
8 |
| cost-effective alternative technologies, raw materials, |
9 |
| and fuels. |
10 |
| The Council shall: |
11 |
| (1) communicate the environmental sustainability |
12 |
| goals to all State agencies; |
13 |
| (2) establish an electronic system to track and |
14 |
| report on environmental progress; |
15 |
| (3) monitor improvement activities; and |
16 |
| (4) propose new goals as appropriate. |
17 |
| (b) Coordinating an awards program that recognizes |
18 |
| units of State and local government and educational |
19 |
| institutions for developing, adopting, and implementing |
20 |
| innovative or exemplary environmental sustainability plans |
21 |
| in conformance with this Act. |
22 |
| (c) Creating specific guidance materials for State |
23 |
| agencies, educational institutions, and units of local |
24 |
| government on how to integrate environmental |
25 |
| sustainability into existing management systems, planning, |
26 |
| and operational practices, while still providing necessary |

| services and ensuring efficient and effective operations. |
2 |
| These guidance materials must include a list of |
3 |
| environmental and energy best practices, case studies, |
4 |
| policy language, model plans, and other resource |
5 |
| information. These materials must be made available on a |
6 |
| website devoted to the Green Governments Illinois program.
|
7 |
| (d) Developing and implementing, to the extent |
8 |
| fiscally feasible, training programs designed to instill |
9 |
| the importance and value of environmental sustainability.
|
10 |
| (e) Providing new ways for State government to build |
11 |
| markets for environmentally preferable products and |
12 |
| services without compromising price, competition, and |
13 |
| availability. The Council shall initially focus on |
14 |
| integrated pest management, bio-based products, recycled |
15 |
| content paper, energy efficiency, renewable energy, |
16 |
| alternative fuel vehicles, and green cleaning supplies. |
17 |
| Within existing resources, and within 60 days after the |
18 |
| effective date of this amendatory Act of the 96th General |
19 |
| Assembly, the Department of Central Management Services , |
20 |
| with the approval of the council, shall designate a single |
21 |
| point of contact for State agencies, suppliers, and other |
22 |
| interested parties to contact regarding environmentally |
23 |
| preferable purchasing issues. |
24 |
| (f) Working collaboratively with State agencies, units |
25 |
| of local government, educational institutions, and the |
26 |
| legislative branches of government to promote |

| benchmarking, commissioning, and retro-commissioning to |
2 |
| make government and institutional buildings more |
3 |
| resource-efficient, energy efficient, and healthful public |
4 |
| places. |

| (g) Reviewing budgetary policy and making |
6 |
| recommendations to the Governor on incentives for State |
7 |
| agencies to undertake environmental improvements that |
8 |
| result in long-term cost-savings, productivity |
9 |
| enhancements, or other outcomes deemed appropriate to the |
10 |
| State's sustainability goals. |
11 |
| (h) Reporting annually to the Governor and the General |
12 |
| Assembly on the results of environmental sustainability |
13 |
| actions taken by State agencies, educational institutions |
14 |
| and units of local government during the prior fiscal |
15 |
| calendar year. The report must include the environmental |
16 |
| and economic benefits of the environmental sustainability |
17 |
| actions, where feasible, the consumption of those actions, |
18 |
| and provide recommendations for future environmental |
19 |
| improvement activities during the following year. The |
20 |
| report shall be filed by September 1, 2008, and November |
21 |
| September 1 of each subsequent year. |
22 |
| (h-5) Participating in the proposal review and |
23 |
| subgrant award processes conducted by the Department of |
24 |
| Commerce and Economic Opportunity to distribute the |
25 |
| portion of funds eligible for State government use under |
26 |
| the federal Energy Independence and Security Act of 2007, |

| H.R. 6, Title V, Subtitle E (Energy Efficiency and |
2 |
| Conservation Block Grants). A designee of the Governor |
3 |
| shall also participate in these processes, and no subgrant |
4 |
| may be awarded unless the Governor's designee first |
5 |
| approves that subgrant. |
6 |
| (i) The chairman of the Council shall determine whether |
7 |
| or not the I-Cycle program is operating effectively and |
8 |
| make recommendations concerning management of the I-Cycle |
9 |
| program. The chairman has the authority to dissolve the |
10 |
| I-Cycle program if the program is found to be ineffective.

13 |
| Sec. 35. Environmental Plans and Reporting. |
14 |
| (a) Each State agency shall submit an adopted environmental |
15 |
| sustainability plan to the chairman of the Council for review |
16 |
| and approval on or before April 1, 2008 November 1, 2007 . |
17 |
| On or before November August 1, 2007, the Council shall |
18 |
| prepare a downloadable plan template designed to provide a |
19 |
| simple framework for the development of an environmental |
20 |
| sustainability plan as required by this Act. The Council shall |
21 |
| adopt procedures for reviewing and approving the plans, and |
22 |
| make staff available during preparation of the plans to assist |
23 |
| State agencies with their plan-writing efforts. The Council |
24 |
| shall complete its plan review process on or before June |
25 |
| January 1, 2008. The sustainability plans shall be reviewed and |

| updated periodically, but at least once every 3 years. Units To |
2 |
| the extent feasible and cost-effective, units of local |
3 |
| government and , educational institutions , and State agencies |
4 |
| are encouraged to submit adopt and implement similar |
5 |
| sustainability plans . Environmental sustainability plans may |
6 |
| be submitted to the chairman of the Council , by request, for |
7 |
| review and approval. |
8 |
| (b) On or before January 1, 2008 August 1, 2007 , each State |
9 |
| agency, using existing resources, shall form an internal |
10 |
| environmental sustainability committee. The environmental |
11 |
| sustainability committee shall (i) assess the environmental |
12 |
| and resource use impacts of its major operational activities |
13 |
| making environmental improvements, conserving resources, and |
14 |
| reducing health risks; (ii) develop an environmental |
15 |
| sustainability plan as required under this Act; and (iii) |
16 |
| establish an ongoing process through which their |
17 |
| sustainability efforts can be reviewed and improved upon. The |
18 |
| committee shall focus on the most significant environmental and |
19 |
| resource use impacts, examine the feasibility and |
20 |
| cost-effectiveness of addressing these impacts, and prioritize |
21 |
| their actions accordingly. |
22 |
| Where feasible, the committee shall quantify the specific |
23 |
| impacts of major operational activities such as gallons of |
24 |
| water used, pounds of solid waste generated, gallons of |
25 |
| gasoline consumed, and dollars spent per year on electricity. |
26 |
| The committee shall consist of representatives from different |

| departments and program areas, including purchasing, |
2 |
| maintenance, and facility management. A senior member of |
3 |
| management shall be designated to coordinate environmental |
4 |
| sustainability efforts of each committee. The coordinator |
5 |
| shall provide information to agency facilities and staff, |
6 |
| coordinate planning and reporting activities, and act as |
7 |
| liaison to the Council. Where appropriate, State agencies may |
8 |
| appoint facility coordinators in addition to the agency |
9 |
| coordinator. Coordinators shall be given full management |
10 |
| support and provided with the necessary resources to meet the |
11 |
| goals of this Act. |
12 |
| (c) On or before July April 1, 2008 and on or before |
13 |
| September April 1 of each subsequent year, each State agency |
14 |
| shall submit to the chairman of the Council a report |
15 |
| summarizing the progress made in implementing its |
16 |
| environmental sustainability plan, including sustainability |
17 |
| measures adopted and goals achieved. The information in this |
18 |
| report shall encompass the previous fiscal calendar year. |
19 |
| On or before June January 1, 2008, the Council shall |
20 |
| develop and adopt a reporting form to be used to comply with |
21 |
| the provisions of this Section. Participating units of local |
22 |
| government , State agencies, and educational institutions are |
23 |
| encouraged to must submit an annual progress report on or |
24 |
| before September June 1, 2008 and on or before June 1 of each |
25 |
| subsequent year. |
26 |
| (d) State agencies shall be invited to participate in the |

| Council's efforts to foster environmental sustainability |
2 |
| practices throughout State government. |
3 |
| (e) The Council shall provide technical assistance to State |
4 |
| agencies, units of local government, and educational |
5 |
| institutions for the purpose of implementing the environmental |
6 |
| sustainability planning requirement. |
7 |
| (f) The Council may establish criteria for exempting select |
8 |
| State agencies from the environmental sustainability planning |
9 |
| based on staff size, probable environmental impacts, and scope |
10 |
| of operations.

| Section 99. Effective date. This Act takes effect upon |
13 |
| becoming law.".
