2 | AMENDMENT NO. ______. Amend House Bill 1060 on page 1, in | ||||||
3 | line 5, by replacing "Section 2" with "Sections 2 and 4"; and
| ||||||
4 | on page 3, by inserting below line 25 the following:
| ||||||
5 | "(25 ILCS 170/4) (from Ch. 63, par. 174)
| ||||||
6 | Sec. 4. Persons not required to register. This Act is not | ||||||
7 | intended and shall
not be construed to apply to the following:
| ||||||
8 | (a) Persons who, for the purpose of influencing executive, | ||||||
9 | legislative or
administrative action and who do not make | ||||||
10 | expenditures that are reportable
pursuant to Section 6, appear | ||||||
11 | without compensation or promise thereof only
as witnesses | ||||||
12 | before committees of the House and Senate or before boards or | ||||||
13 | commissions described in subsection (c)(3.5) of Section 2 for | ||||||
14 | the purpose of
explaining or arguing for or against the passage | ||||||
15 | of or action upon any
legislation then pending before such | ||||||
16 | committees or upon any issue or matter over which such board or |

| |||||||
1 | commission has jurisdiction , or who seek without
compensation | ||||||
2 | or promise thereof the approval or veto of any legislation by
| ||||||
3 | the Governor.
| ||||||
4 | (b) Persons who own, publish, or are employed by a | ||||||
5 | newspaper or other
regularly published periodical, or who own | ||||||
6 | or are employed by a radio
station, television station, or | ||||||
7 | other bona fide news medium which in the
ordinary course of | ||||||
8 | business disseminates news, editorial or other comment,
or paid | ||||||
9 | advertisements which directly urge the passage or defeat of
| ||||||
10 | legislation. This exemption shall not be applicable to such an | ||||||
11 | individual
insofar as he receives additional compensation or | ||||||
12 | expenses from some source
other than the bona fide news medium | ||||||
13 | for the purpose of influencing
executive, legislative or | ||||||
14 | administrative action. This exemption
does not apply to | ||||||
15 | newspapers and periodicals owned by or published by trade
| ||||||
16 | associations and profit corporations engaged primarily in | ||||||
17 | endeavors other
than dissemination of news.
| ||||||
18 | (c) Persons performing professional services in drafting | ||||||
19 | bills or in
advising and rendering opinions to clients as to | ||||||
20 | the construction and
effect of proposed or pending legislation | ||||||
21 | where such professional services
are not otherwise, directly or | ||||||
22 | indirectly, connected with executive,
legislative or | ||||||
23 | administrative action.
| ||||||
24 | (d) Persons who are employees of departments, divisions, or | ||||||
25 | agencies of
State government, and who appear before committees | ||||||
26 | of the House and Senate
for the purpose of explaining how the |

| |||||||
1 | passage of or action upon any
legislation then pending before | ||||||
2 | such committees will affect said
departments, divisions or | ||||||
3 | agencies of State government.
| ||||||
4 | (e) Employees of the General Assembly legislators, | ||||||
5 | legislative agencies
and legislative commissions.
| ||||||
6 | (f) Persons who possess technical skills and knowledge | ||||||
7 | relevant to certain
areas of executive, legislative or | ||||||
8 | administrative actions, whose skills and
knowledge would be | ||||||
9 | helpful to officials when considering such actions, whose
| ||||||
10 | activities are limited to making occasional appearances for or | ||||||
11 | communicating on
behalf of a registrant and who do not make | ||||||
12 | expenditures that are reportable
pursuant to Section 6 even | ||||||
13 | though receiving expense reimbursement for such
occasional | ||||||
14 | appearances.
| ||||||
15 | (g) Any full time employee of a bona-fide church or | ||||||
16 | religious
organization who represents that organization solely | ||||||
17 | for the purpose of
protecting the right of the members thereof | ||||||
18 | to practice the religious
doctrines of such church or religious | ||||||
19 | organization.
| ||||||
20 | (h) Persons who receive no compensation other than | ||||||
21 | reimbursement for
expenses of up to $500 per year while engaged | ||||||
22 | in lobbying State government,
unless those persons make | ||||||
23 | expenditures that are reportable under Section 6.
| ||||||
24 | (i) Any attorney in the course of representing a client in | ||||||
25 | any
administrative or judicial proceeding, or any witness | ||||||
26 | providing testimony in
any administrative or judicial |
| |||||||
| |||||||
1 | proceeding, in which ex parte communications are
not allowed | ||||||
2 | and who does not make expenditures that are reportable pursuant
| ||||||
3 | to Section 6.
| ||||||
4 | (j) Persons who, in the scope of their employment as a | ||||||
5 | vendor, offer or
solicit an official for the purchase of any | ||||||
6 | goods or services where (1) said
solicitation is limited to | ||||||
7 | either an oral inquiry or written advertisements and
| ||||||
8 | informative literature; or (2) said goods and services are | ||||||
9 | subject to
competitive bidding requirements of the Illinois | ||||||
10 | Purchasing Act; or (3) said
goods and services are for sale at | ||||||
11 | a cost not to exceed $5,000; and (4) such
persons do not make | ||||||
12 | expenditures that are reportable under Section 6.
