SYNOPSIS AS INTRODUCED:
 
20 ILCS 205/205-360 new

    Amends the Department of Agriculture Law of the Civil Administrative Code of Illinois. Requires the Department to develop and administer a 3-year pilot program of waivers of motor fuel content rules and standards to retail fuel marketers who sell motor fuel blends containing 10% to 85% ethanol by volume. Limits to 25 the number of pump sites for which waivers may be issued. Limits pump sites to one per waiver applicant. Requires the Department to adopt rules and report to the Governor and General Assembly. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Agriculture Law of the Civil
5 Administrative Code of Illinois is amended by adding Section
6 205-360 as follows:
 
7     (20 ILCS 205/205-360 new)
8     Sec. 205-360. Increased ethanol content pilot program.
9     (a) The General Assembly finds:
10         (1) Due to the increasing cost of motor fuel, gas
11     stations in this State should be encouraged to offer motor
12     fuel blends containing 10% to 85% ethanol by volume.
13     Increasing the percentage of ethanol in motor fuel will
14     help to reduce the cost of motor fuel.
15         (2) Motor vehicle manufacturers are encouraged to
16     continue to expand production of flexible-fuel vehicles.
17     Flexible-fuel vehicles are capable of using motor fuel
18     blends containing 10% to 85% ethanol by volume.
19     (b) The Department shall develop, implement, and
20 administer a 3-year pilot program to encourage Illinois gas
21 stations to sell motor fuel blends containing 10% to 85%
22 ethanol by volume. As an incentive for that sale, the
23 Department shall waive the otherwise applicable rules and ASMT

1 International standards with respect to the ethanol content of
2 motor fuel for 25 pump sites throughout the State. The
3 Department shall develop the criteria for evaluating the
4 voluntary applications of retail fuel marketers and for
5 granting the waivers, which shall be limited to one pump site
6 waiver per applicant.
7     At the conclusion of the program, the Department shall
8 report to the Governor and General Assembly upon its conduct
9 and assessment of the program.
10     The Department shall adopt rules for the implementation of
11 this Section.
 
12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
