AMENDMENT TO HOUSE BILL 1376

2    AMENDMENT NO. ______. Amend House Bill 1376 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by changing
5Sections 4-10 and 4-15 as follows:
 
6    (35 ILCS 200/4-10)
7    Sec. 4-10. Compensation for Certified Illinois Assessing
8Officers. Subject to the requirements for continued training,
9any supervisor of assessments, assessor, deputy assessor or
10member of a board of review in any county who has earned a
11Certified Illinois Assessing Officers Certificate from the
12Illinois Property Assessment Institute shall receive from the
13State, out of funds appropriated to the Department, additional
14compensation of $500 per year.
15    To receive a Certified Illinois Assessing Officer
16certificate, a person shall complete successfully and pass

1examinations on a basic course in assessment practice approved
2by the Department and conducted by the Institute and additional
3courses totaling not less than 60 class hours that are
4designated and approved by the Department, on the cost, market
5and income approaches to value, mass appraisal techniques, and
6property tax administration.
7    To continue to be eligible for the additional compensation,
8a Certified Illinois Assessing Officer must complete
9successfully a minimum of 15 class hours requiring a written
10examination, and the equivalent of one seminar course of 15
11class hours which does not require a written examination, in
12each year for which additional compensation is sought after
13receipt of the certificate. The Department shall designate and
14approve courses acceptable for additional training, including
15courses in business and computer techniques, and class hours
16applicable to each course. The Department shall specify
17procedures for certifying the completion of the additional
18training.
19    The courses and training shall be conducted annually at
20various convenient locations throughout the State. At least one
21course shall be conducted annually in each county with more
22than 400,000 inhabitants.
23    Notwithstanding any provision of this Code to the contrary,
24no additional compensation under this Section shall be paid by
25the State to a county supervisor of assessments, assessor,
26deputy assessor, or member of a board of review in State Fiscal

1Year 2012 or any State Fiscal Year thereafter.

5    Sec. 4-15. Compensation of local assessment officers
6holding other designations. Any assessor, deputy assessor or
7member of a board of review who has been awarded a Certified
8Assessment Evaluator certificate by the International
9Association of Assessing Officers shall receive an additional
10compensation of $500 per year from funds appropriated to the
11Department.
12    Any assessor, deputy assessor or member of a board of
13review who has been awarded a Residential Evaluation
14Specialist, Assessment Administration Specialist, or Cadastral
15Mapping Specialist certificate by the International
16Association of Assessing Officers, but who has not been awarded
17a Certified Assessment Evaluator certificate, shall receive
18additional compensation of $250 per year from funds
19appropriated to the Department. If any assessor, deputy
20assessor, or member of a board of review has been awarded more
21than one certificate, but has not been awarded a Certified
22Assessment Evaluator certificate, the maximum additional
23compensation shall be $250.
24    To continue to qualify for the additional compensation
25after receipt of a certificate, any assessor, deputy assessor

1or member of a board of review must, each year that additional
2compensation is sought, complete successfully a minimum of 15
3class hours requiring a written examination, and the equivalent

8the State to a county assessor, deputy assessor, or member of a

12    Section 10. The Counties Code is amended by changing
13Sections 3-10007, 4-6001, 4-6002, 4-6003, and 4-8002 as
14follows:
 
15    (55 ILCS 5/3-10007)  (from Ch. 34, par. 3-10007)
16    Sec. 3-10007. Annual stipend. In addition to all other
17compensation provided by law, every elected county treasurer,
18for additional duties mandated by State law, shall receive an
19annual stipend of (i) $5,000 if his or her term begins before
20December 1, 1998, (ii) $5,500 after December 1, 1998 and $6,500
21after December 1, 1999 if his or her term begins on or after
22December 1, 1998 but before December 1, 2000, and (iii) $6,500
23if his or her term begins December 1, 2000 or thereafter, to be
24annually appropriated from the General Revenue Fund by the

1General Assembly to the Department of Revenue which shall
2distribute the awards in annual lump sum payments to every
3elected county treasurer. This annual stipend shall not affect
4any other compensation provided by law to be paid to elected
5county treasurers. No county board may reduce or otherwise
6impair the compensation payable from county funds to an elected
7county treasurer if such reduction or impairment is the result
8of his or her receiving an annual stipend under this Section.
9    Notwithstanding any provision of this Code to the contrary,
10no annual stipend under this Section shall be paid by the State
11to a treasurer in State Fiscal Year 2012 or any State Fiscal
12Year thereafter.

15    Sec. 4-6001. Officers in counties of less than 2,000,000.
16    (a) In all counties of less than 2,000,000 inhabitants, the
17compensation of Coroners, County Treasurers, County Clerks,
18Recorders and Auditors shall be determined under this Section.
19The County Board in those counties shall fix the amount of the
20necessary clerk hire, stationery, fuel and other expenses of
21those officers. The compensation of those officers shall be
22separate from the necessary clerk hire, stationery, fuel and
23other expenses, and such compensation (except for coroners in
24those counties with less than 2,000,000 population in which the

14-6002) shall be fixed within the following limits:
2    To each such officer in counties containing less than
314,000 inhabitants, not less than $13,500 per annum.
4    To each such officer in counties containing 14,000 or more
5inhabitants, but less than 30,000 inhabitants, not less than
6$14,500 per annum.
7    To each such officer in counties containing 30,000 or more
8inhabitants but less than 60,000 inhabitants, not less than
9$15,000 per annum.
10    To each such officer in counties containing 60,000 or more
11inhabitants but less than 100,000 inhabitants, not less than
12$15,000 per annum.
13    To each such officer in counties containing 100,000 or more
14inhabitants but less than 200,000 inhabitants, not less than
15$16,500 per annum.
16    To each such officer in counties containing 200,000 or more
17inhabitants but less than 300,000 inhabitants, not less than
18$18,000 per annum.
19    To each such officer in counties containing 300,000 or more
20inhabitants but less than 2,000,000 inhabitants, not less than
21$20,000 per annum.
22    (b) Those officers beginning a term of office before
23December 1, 1990 shall be compensated at the rate of their base
24salary. "Base salary" is the compensation paid for each of
25those offices, respectively, before July 1, 1989.
26    (c) Those officers beginning a term of office on or after

1December 1, 1990 shall be compensated as follows:
2        (1) Beginning December 1, 1990, base salary plus at
3    least 3% of base salary.
4        (2) Beginning December 1, 1991, base salary plus at
5    least 6% of base salary.
6        (3) Beginning December 1, 1992, base salary plus at
7    least 9% of base salary.
8        (4) Beginning December 1, 1993, base salary plus at
9    least 12% of base salary.
10    (d) In addition to but separate and apart from the
11compensation provided in this Section, the county clerk of each
12county, the recorder of each county, and the chief clerk of
13each county board of election commissioners shall receive an
14award as follows:
15        (1) $4,500 per year after January 1, 1998;
16        (2) $5,500 per year after January 1, 1999; and
17        (3) $6,500 per year after January 1, 2000.
18The total amount required for such awards each year shall be
19appropriated by the General Assembly to the State Board of
20Elections which shall distribute the awards in annual lump sum
21payments to the several county clerks, recorders, and chief
22election clerks. Beginning December 1, 1990, this annual award,
23and any other award or stipend paid out of State funds to
24county officers, shall not affect any other compensation
25provided by law to be paid to county officers.
26    (e) Beginning December 1, 1990, no county board may reduce

1or otherwise impair the compensation payable from county funds
2to a county officer if the reduction or impairment is the
3result of the county officer receiving an award or stipend
4payable from State funds.
5    (f) The compensation, necessary clerk hire, stationery,
6fuel and other expenses of the county auditor, as fixed by the
7county board, shall be paid by the county.
8    (g) The population of all counties for the purpose of
9fixing compensation, as herein provided, shall be based upon
10the last Federal census immediately previous to the election of
11the officer in question in each county.
12    (h) With respect to an auditor who takes office on or after
13the effective date of this amendatory Act of the 95th General
14Assembly, the auditor shall receive an annual stipend of $6,500
15per year. The General Assembly shall appropriate the total
16amount required for the stipend each year to the Department of
17Revenue, and the Department of Revenue shall distribute the
18awards in an annual lump sum payment to each county auditor.
19The stipend shall be in addition to, but separate and apart
20from, the compensation provided in this Section. No county
21board may reduce or otherwise impair the compensation payable
22from county funds to the auditor if the reduction or impairment
23is the result of the auditor receiving an award or stipend
24pursuant to this subsection.
25    (i) Notwithstanding any provision of this Code to the
26contrary, no annual stipend under this Section shall be paid by

1the State to a coroner, treasurer, county clerk, recorder, or
2auditor in State Fiscal Year 2012 or any State Fiscal Year
3thereafter.

6    Sec. 4-6002. Coroners in counties of less than 2,000,000.
7    (a) The County Board, in all counties of less than
82,000,000 inhabitants, shall fix the compensation of Coroners
9within the limitations fixed by this Division, and shall
10appropriate for their necessary clerk hire, stationery, fuel,
11supplies, and other expenses. The compensation of the Coroner
12shall be fixed separately from his or her necessary clerk hire,
13stationery, fuel and other expenses, and such compensation
14shall be fixed within the following limits:
15    To each Coroner in counties containing less than 5,000
16inhabitants, not less than $4,500 per annum.
17    To each Coroner in counties containing 5,000 or more
18inhabitants but less than 14,000 inhabitants, not less than
19$6,000 per annum.
20    To each Coroner in counties containing 14,000 or more
21inhabitants, but less than 30,000 inhabitants, not less than
22$9,000 per annum.
23    To each Coroner in counties containing 30,000 or more
24inhabitants, but less than 60,000 inhabitants, not less than
25$14,000 per annum.

1    To each Coroner in counties containing 60,000 or more
2inhabitants, but less than 100,000 inhabitants, not less than
3$15,000 per annum.
4    To each Coroner in counties containing 100,000 or more
5inhabitants, but less than 200,000 inhabitants, not less than
6$16,500 per annum.
7    To each Coroner in counties containing 200,000 or more
8inhabitants, but less than 300,000 inhabitants, not less than
9$18,000 per annum.
10    To each Coroner in counties containing 300,000 or more
11inhabitants, but less than 2,000,000 inhabitants, not less than
12$20,000 per annum.
13    The population of all counties for the purpose of fixing
14compensation, as herein provided, shall be based upon the last
15Federal census immediately previous to the election of the
16Coroner in question in each county. This Section does not apply
17to a county which has abolished the elective office of coroner.
18    (b) Those coroners beginning a term of office on or after
19December 1, 1990 shall be compensated as follows:
20        (1) Beginning December 1, 1990, base salary plus at
21    least 3% of base salary.
22        (2) Beginning December 1, 1991, base salary plus at
23    least 6% of base salary.
24        (3) Beginning December 1, 1992, base salary plus at
25    least 9% of base salary.
26        (4) Beginning December 1, 1993, base salary plus at

1    least 12% of base salary.
2    "Base salary", as used in this subsection (b), means the
3salary in effect before July 1, 1989.
4    (c) In addition to, but separate and apart from, the
5compensation provided in this Section, the coroner of each
6county shall receive an annual stipend of $6,500 to be paid by
7the State if his or her term begins on or after December 1,
82000.
9    (d) Notwithstanding any provision of this Code to the
10contrary, no annual stipend under this Section shall be paid by
11the State to a coroner in State Fiscal year 2012 or any State
12Fiscal Year thereafter.

15    Sec. 4-6003. Compensation of sheriffs for certain expenses
16in counties of less than 2,000,000.
17    (a) The County Board, in all counties of less than
182,000,000 inhabitants, shall fix the compensation of sheriffs,
19with the amount of their necessary clerk hire, stationery, fuel
20and other expenses. The county shall supply the sheriff with
21all necessary uniforms, guns and ammunition. The compensation
22of each such officer shall be fixed separately from his or her
23necessary clerk hire, stationery, fuel and other expenses.
24Beginning immediately, no county with a population under
252,000,000 may reduce the rate of compensation of its sheriff

1below the rate of compensation that it was actually paying to
2its sheriff on January 1, 2002 or the effective date of this
3amendatory Act of the 92nd General Assembly, whichever is
4greater.
5    (b) In addition to the requirement of subsection (a), the
6rate of compensation payable to the sheriff by the county shall
7not be less than the following:
8    To each such sheriff in counties containing less than
910,000 inhabitants, not less than $27,000 per annum.
10    To each such sheriff in counties containing 10,000 or more
11inhabitants but less than 20,000 inhabitants, not less than
12$31,000 per annum.
13    To each such sheriff in counties containing 20,000 or more
14inhabitants but less than 30,000 inhabitants, not less than
15$34,000 per annum.
16    To each such sheriff in counties containing 30,000 or more
17inhabitants but less than 60,000 inhabitants, not less than
18$37,000 per annum.
19    To each such sheriff in counties containing 60,000 or more
20inhabitants but less than 100,000 inhabitants, not less than
21$40,000 per annum.
22    To each such sheriff in counties containing 100,000 or more
23inhabitants but less than 2,000,000 inhabitants, not less than
24$43,000 per annum.
25    The population of each county for the purpose of fixing
26compensation as herein provided, shall be based upon the last

1federal census immediately previous to the election of the
2sheriff in question in such county.
3    (c) (Blank).
4    (d) In addition to the salary provided for in subsections
5(a), (b), and (c), beginning December 1, 1998, each sheriff,
6for his or her additional duties imposed by other statutes or
7laws, shall receive an annual stipend to be paid by the State
8in the amount of $6,500.
9    (e) No county board may reduce or otherwise impair the
10compensation payable from county funds to a sheriff if the
11reduction or impairment is the result of the sheriff receiving
12an award or stipend payable from State funds.
13    (f) Notwithstanding any provision of this Code to the
14contrary, no annual stipend under this Section shall be paid by
15the State to a sheriff in State Fiscal Year 2012 or any State
16Fiscal Year thereafter.

2the sheriff if the reduction or impairment is the result of the
3sheriff receiving a stipend payable from State funds.
4    (b) In addition to any salary otherwise provided by law,
5beginning December 1, 2000, the recorder of deeds of Cook
6County for his or her additional duties imposed by law shall
7receive an annual stipend to be paid by the State in an amount
8equal to the stipend paid to each recorder in other counties
9under subsection (d) of Section 4-6001 of this Code. The county
10board may not reduce or otherwise impair the compensation
11payable from county funds to the recorder of deeds if the
12reduction or impairment is the result of the recorder of deeds
13receiving a stipend payable from State funds.
14    (c) Notwithstanding any provision of this Code to the
15contrary, no annual stipend under this Section shall be paid by
16the State to a sheriff or recorder in State Fiscal Year 2012 or
17any State Fiscal Year thereafter.

19    Section 15. The Clerks of Courts Act is amended by changing
20Section 27.3 as follows:

23    (a) The county board shall provide the compensation of
24Clerks of the Circuit Court, and the amount necessary for clerk

1hire, stationery, fuel and other expenses. Beginning December
21, 1989, the compensation per annum for Clerks of the Circuit
3Court shall be as follows:
4    In counties where the population is:
5Less than 14,000.......................at least $13,500
614,001-30,000..........................at least $14,500
730,001-60,000..........................at least $15,000
860,001-100,000.........................at least $15,000
9100,001-200,000........................at least $16,500
10200,001-300,000........................at least $18,000
11300,001- 3,000,000.....................at least $20,000
12Over 3,000,000.........................at least $55,000
13    (b) In counties in which the population is 3,000,000 or
14less, "base salary" is the compensation paid for each Clerk of
15the Circuit Court, respectively, before July 1, 1989.
16    (c) The Clerks of the Circuit Court, in counties in which
17the population is 3,000,000 or less, shall be compensated as
18follows:
19        (1) Beginning December 1, 1989, base salary plus at
20    least 3% of base salary.
21        (2) Beginning December 1, 1990, base salary plus at
22    least 6% of base salary.
23        (3) Beginning December 1, 1991, base salary plus at
24    least 9% of base salary.
25        (4) Beginning December 1, 1992, base salary plus at
26    least 12% of base salary.

1    (d) In addition to the compensation provided by the county
2board, each Clerk of the Circuit Court shall receive an award
3from the State for the additional duties imposed by Sections
45-9-1 and 5-9-1.2 of the Unified Code of Corrections, Section
510 of the Violent Crime Victims Assistance Act, Section 16-104a
6of the Illinois Vehicle Code, and other laws, in the following
7amount:
8    (1) $3,500 per year before January 1, 1997.
9    (2) $4,500 per year beginning January 1, 1997.
10    (3) $5,500 per year beginning January 1, 1998.
11    (4) $6,500 per year beginning January 1, 1999.
12The total amount required for such awards shall be appropriated
13each year by the General Assembly to the Supreme Court, which
14shall distribute such awards in annual lump sum payments to the
15Clerks of the Circuit Court in all counties. This annual award,
16and any other award or stipend paid out of State funds to the
17Clerks of the Circuit Court, shall not affect any other
18compensation provided by law to be paid to Clerks of the
19Circuit Court.
20    (e) Also in addition to the compensation provided by the
21county board, Clerks of the Circuit Court in counties in which
22one or more State correctional institutions are located shall
23receive a minimum reimbursement in the amount of $2,500 per
24year for administrative assistance to perform services in
25connection with the State correctional institution, payable
26monthly from the State Treasury to the treasurer of the county

1in which the additional staff is employed. Counties whose State
2correctional institution inmate population exceeds 250 shall
3receive reimbursement in the amount of $2,500 per 250 inmates.
4This subsection (e) shall not apply to staff added before
5November 29, 1990.
6    For purposes of this subsection (e), "State correctional
7institution" means any facility of the Department of
8Corrections, including without limitation adult facilities,
9juvenile facilities, pre-release centers, community correction
10centers, and work camps.
11    (f) No county board may reduce or otherwise impair the
12compensation payable from county funds to a Clerk of the
13Circuit Court if the reduction or impairment is the result of
14the Clerk of the Circuit Court receiving an award or stipend
15payable from State funds.
16    (g) Notwithstanding any provision of this Act to the
17contrary, no annual stipend under this Section shall be paid by
18the State to a Clerk of the Circuit Court in State Fiscal Year
192012 or any State Fiscal Year thereafter.
