2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:

4 | Section 5. The State Finance Act is amended by changing | ||||||
5 | Sections 8.46 and 8.49 as follows: | ||||||
6 | (30 ILCS 105/8.46) | ||||||
7 | Sec. 8.46. Transfers to the FY09 Budget Relief Fund. | ||||||
8 | (a) The FY09 Budget Relief Fund is created as a special | ||||||
9 | fund in the State Treasury. Amounts may be expended from the | ||||||
10 | Fund only pursuant to specific authorization by appropriation. | ||||||
11 | (b) Notwithstanding any other State law to the contrary, | ||||||
12 | the State Treasurer and State Comptroller are directed to | ||||||
13 | transfer to the FY09 Budget Relief Fund the following amounts | ||||||
14 | from the funds specified, in equal quarterly installments with | ||||||
15 | the first made on the effective date of this amendatory Act of | ||||||
16 | the 95th General Assembly, or as soon thereafter as practical, | ||||||
17 | and with the remaining transfers to be made on October 1, 2008, | ||||||
18 | January 1, 2009, and April 1, 2009, or as soon thereafter as | ||||||

10 | the funds listed in subsection (b) have insufficient cash from
| ||||||
11 | which the State Comptroller may make expenditures properly
| ||||||
12 | supported by appropriations from the fund, then the State
| ||||||
13 | Treasurer and State Comptroller shall transfer from the FY09 | ||||||
14 | Budget Relief Fund to the fund only such amount as is | ||||||
15 | immediately
necessary to satisfy outstanding expenditure | ||||||
16 | obligations on a
timely basis, subject to the provisions of the | ||||||
17 | State Prompt
Payment Act. All or a portion of the
amounts | ||||||
18 | transferred from the FY09 Budget Relief
Fund to a fund pursuant | ||||||
19 | to this subsection (c) from time to
time may
be re-transferred | ||||||
20 | by the State Comptroller and the
State Treasurer from the | ||||||
21 | receiving fund into the FY09 Budget Relief Fund as soon as and | ||||||
22 | to the extent that deposits are
made into or receipts are | ||||||
23 | collected by the receiving fund. | ||||||
24 | (d) In addition to any other transfers that may be provided | ||||||
25 | for by law, on December 1, 2010, or as soon thereafter as may | ||||||
26 | be practical, the State Comptroller shall direct and the State |

1 | Treasurer shall transfer the sum of $500,000 from the FY09 | ||||||

17 | All of these transfers shall be made in equal quarterly | ||||||
18 | installments with the first made on July 1, 2009, or as soon | ||||||
19 | thereafter as practical, and with the remaining transfers to be | ||||||
20 | made on October 1, January 1, and April 1, or as soon | ||||||
21 | thereafter as practical. These transfers shall be made | ||||||
22 | notwithstanding any other provision of State law to the | ||||||
23 | contrary. | ||||||
24 | (b) On and after the effective date of this amendatory Act | ||||||
25 | of the 96th General Assembly through June 30, 2010, when any of | ||||||
26 | the funds listed in subsection (a) have insufficient cash from |

1 | which the State Comptroller may make expenditures properly | ||||||
2 | supported by appropriations from the fund, then the State | ||||||
3 | Treasurer and State Comptroller shall transfer from the General | ||||||
4 | Revenue Fund to the fund such amount as is immediately | ||||||
5 | necessary to satisfy outstanding expenditure obligations on a | ||||||
6 | timely basis, subject to the provisions of the State Prompt | ||||||
7 | Payment Act.
| ||||||
8 | (c) If the Director of the Governor's Office of Management | ||||||
9 | and Budget determines that any transfer to the General Revenue | ||||||
10 | Fund from a special fund under subsection (a) either (i) | ||||||
11 | jeopardizes federal funding based on a written communication | ||||||
12 | from a federal official or (ii) violates an order of a court of | ||||||
13 | competent jurisdiction, then the Director may order the State | ||||||
14 | Treasurer and State Comptroller, in writing, to transfer from | ||||||
15 | the General Revenue Fund to that listed special fund all or | ||||||
16 | part of the amounts transferred from that special fund under | ||||||
17 | subsection (a). | ||||||
18 | (d) In addition to any other transfers that may be provided | ||||||
19 | for by law, on December 1, 2010, or as soon thereafter as may | ||||||
20 | be practical, the State Comptroller shall direct and the State | ||||||
21 | Treasurer shall transfer the following amounts from the General | ||||||
22 | Revenue Fund to the designated funds: | ||||||

2 | Section 10. The Criminal Code of 1961 is amended by | ||||||
3 | changing Section 11-19.3 as follows: | ||||||
4 | (720 ILCS 5/11-19.3) | ||||||
5 | Sec. 11-19.3. Vehicle impoundment. | ||||||
6 | (a) In addition to any other penalty provided by law, a | ||||||
7 | peace officer who arrests a person for a violation of Section | ||||||
8 | 10-9, 11-14 10-14 , 11-14.1, 11-15, 11-15.1, 11-16, 11-17, | ||||||
9 | 11-17.1, 11-18, 11-18.1, 11-19, 11-19.1, or 11-19.2 of this | ||||||
10 | Code, may tow and impound any vehicle used by the person in the | ||||||
11 | commission of the offense. The person arrested for one or more | ||||||
12 | such violations shall be charged a $1,000 fee, to be paid to | ||||||
13 | the unit of government that made the arrest. The person may | ||||||
14 | recover the vehicle from the impound after a minimum of 2 hours | ||||||
15 | after arrest upon payment of the fee. | ||||||
16 | (b) $500 of the fee shall be distributed to the unit of | ||||||
17 | government whose peace officers made the arrest, for the costs | ||||||
18 | incurred by the unit of government to tow and impound the | ||||||
19 | vehicle. Upon the defendant's conviction of one or more of the | ||||||
20 | offenses in connection with which the vehicle was impounded and | ||||||
21 | the fee imposed under this Section, the remaining $500 of the | ||||||
22 | fee shall be deposited into the DHS State Projects Violent | ||||||
23 | Crime Victims Assistance Fund and shall be used by the | ||||||
24 | Department of Human Services to make grants to non-governmental |

1 | organizations to provide services for persons encountered | ||||||
2 | during the course of an investigation into any violation of | ||||||
3 | Section 10-9, 11-14, 11-14.1, 11-15, 11-15.1, 11-16, 11-17, | ||||||
4 | 11-17.1, 11-18, 11-18.1, 11-19, 11-19.1, or 11-19.2 of this | ||||||
5 | Code, provided such persons constitute prostituted persons or | ||||||
6 | other victims of human trafficking. | ||||||
7 | (c) Upon the presentation by the defendant of a signed | ||||||
8 | court order showing that the defendant has been acquitted of | ||||||
9 | all of the offenses in connection with which a vehicle was | ||||||
10 | impounded and a fee imposed under this Section, or that the | ||||||
11 | charges against the defendant for those offenses have been | ||||||
12 | dismissed, the unit of government shall refund the $1,000 fee | ||||||
13 | to the defendant.
