2 | | Sec. 11-39-2.5. Permits for demolition and renovation; |
3 | | asbestos. Before a municipality may issue a demolition or |
4 | | renovation permit for property that is regulated under Part 61 |
5 | | of Title 40 of the Code of Federal Regulations (NESHAP), the |
6 | | municipality must notify the permit applicant of the |
7 | | requirement to file a NESHAP notification form, as required by |
8 | | Section 61.145(b) of Title 40 of the Code of Federal |
9 | | Regulations, and the permit applicant must certify as a part of |
10 | | the permit application that the NESHAP notification form has |
11 | | been filed with the Illinois Environmental Protection Agency. A |
12 | | municipality may seek assistance from the Illinois |
13 | | Environmental Protection Agency or any other State agency in |
14 | | developing procedures to implement the provisions of this |
15 | | Section. |
16 | | Section 90. The State Mandates Act is amended by adding |
17 | | Section 8.35 as follows: |

19 | | Sec. 8.35. Exempt mandate. Notwithstanding Sections 6 and 8 |
20 | | of this Act, no reimbursement by the State is required for the |
21 | | implementation of any mandate created by this amendatory Act of |
22 | | the 96th General Assembly.

23 | | Section 99. Effective date. This Act takes effect 90 days |
24 | | after becoming law.
