AMENDMENT TO HOUSE BILL 1683

    AMENDMENT NO. ______. Amend House Bill 1683  by replacing

everything after the enacting clause with the following:

    "Section 5. The University of Illinois Act is amended  by 
5
adding Section 45 as follows:
 
6
    (110 ILCS 305/45  new)
7
    Sec. 45. Property right in education; due process. Students 
8
of the University shall have a property right in their 
9
education.  If a student is suspended or expelled by the 
10
University, the University must comply with the due process 
11
provisions of the United States and Illinois Constitutions.
 
12
    Section 10. The Southern Illinois University Management 
13
Act is amended  by adding Section 30 as follows:

    (110 ILCS 520/30  new)

    Sec. 30. Property right in education; due process. Students

of the University shall have a property right in their 
3
education.  If a student is suspended or expelled by the

University, the University must comply with the due process

provisions of the United States and Illinois Constitutions.

    Section 15. The Chicago State University Law is amended  by 
7
adding Section 5-140 as follows:

    (110 ILCS 660/5-140  new)

    Sec. 5-140. Property right in education; due process.

Students of the University shall have a property right in their 
11
education.  If a student is suspended or expelled by the 
12
University, the University must comply with the due process 
13
provisions of the United States and Illinois Constitutions.

    Section 20. The Eastern Illinois University Law is amended  
15
by adding Section 10-140 as follows:

    (110 ILCS 665/10-140  new)

    Sec. 10-140. Property right in education; due process.

Students of the University shall have a property right in their

education.  If a student is suspended or expelled by the 
20
University, the University must comply with the due process 
21

by adding Section 35-145 as follows:

    (110 ILCS 690/35-145  new)

    Sec. 35-145. Property right in education; due process.

Students of the University shall have a property right in their

education.  If a student is suspended or expelled by the 
18
University, the University must comply with the due process 
19
provisions of the United States and Illinois Constitutions.

    Section 99. Effective date. This Act takes effect upon 
21
becoming law.".
