AMENDMENT TO HOUSE BILL 2254

    AMENDMENT NO. ______. Amend House Bill 2254, AS AMENDED, by

replacing everything after the enacting clause with the 
4
following:

    "Section 5. The School Code is amended  by adding Section 
6
14-17 as follows:
 
7
    (105 ILCS 5/14-17 new)
8
    Sec. 14-17. Additional procedures for children suspected 
9
of having a specific learning disability. 
10
    (a)     A school district may, but is not required to, begin 
11
implementing the use of a process that determines how the child 
12
responds to scientific, research-based interventions as part 
13
of the evaluation procedures described in 34 CFR 300.304. When 
14
a district implements the use of a process of this type, the 
15
district shall not use a child's participation in the process 
16
as the basis for denying a parent's request for an evaluation.

    (b)     No later than the beginning of the 2012-2013 school 
2
year, a school district shall begin implementing the use of a 
3
process that determines how the child responds to scientific, 
4
research-based interventions as part of the evaluation 
5
procedures described in 34 CFR 300.304. When a district 
6
implements the use of a process of this type, the district 
7
shall not use a child's participation in the process as the 
8
basis for denying a parent's request for an evaluation.

    Section 99. Effective date. This Act takes effect upon 
10
becoming law.".
