AMENDMENT TO HOUSE BILL 2331

2     AMENDMENT NO. ______. Amend House Bill 2331 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Veterinary Medicine and Surgery Practice
5 Act of 2004 is amended by changing Section 11 as follows:
 
6     (225 ILCS 115/11)  (from Ch. 111, par. 7011)
7     (Section scheduled to be repealed on January 1, 2014)
8     Sec. 11. Practice pending licensure. Temporary permits. A
9 person holding the degree of Doctor of Veterinary Medicine, or
10 its equivalent, from an accredited college of veterinary
11 medicine, and who has applied in writing to the Department for
12 a license to practice veterinary medicine and surgery in any of
13 its branches, and who has fulfilled the requirements of Section
14 8 of this Act, with the exception of receipt of notification of
15 his or her examination results, may receive, at the discretion
16 of the Department, a temporary permit to practice under the

1 direct supervision of a veterinarian who is licensed in this
2 State, until: (1) the applicant has been notified of his or her
3 failure to pass the results of the examination authorized by
4 the Department; or (2) the applicant has withdrawn his or her
5 application; (3) the applicant has received a license from the
6 Department after successfully passing the examination
7 authorized by the Department; or (4) the applicant has been
8 notified by the Department to cease and desist from practicing.
9     A temporary permit may be issued by the Department to a
10 person who is a veterinarian licensed under the laws of another
11 state, a territory of the United States, or a foreign country,
12 upon application in writing to the Department for a license
13 under this Act if he or she is qualified to receive a license
14 and until: (1) the expiration of 6 months after the filing of
15 the written application, (2) the withdrawal of the application
16 or (3) the denial of the application by the Department.
17     A temporary permit issued under this Section shall not be
18 extended or renewed. The holder of a temporary permit The
19 applicant shall perform only those acts that may be prescribed
20 by and incidental to his or her employment and those acts that
21 act shall be performed under the direction of a supervising
22 veterinarian who is licensed in this State. The applicant
23 holder of the temporary permit shall not be entitled to
24 otherwise engage in the practice of veterinary medicine until
25 fully licensed in this State.

1 Department shall immediately notify, by certified mail, the
2 supervising veterinarian employing the applicant and the
3 applicant that the applicant shall immediately cease and desist
4 from practicing if the applicant (1) practices outside his or
5 her employment under a licensed veterinarian; (2) violates any
6 provision of this Act; or (3) becomes ineligible for licensure
7 under this Act. holder of a temporary permit and the holder of
8 the permit. A temporary permit shall be revoked by the
9 Department upon proof that the holder of the permit has engaged
10 in the practice of veterinary medicine in this State outside
11 his or her employment under a licensed veterinarian.

13     Section 99. Effective date. This Act takes effect upon
14 becoming law.".
