| 1 | AN ACT concerning property.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. "An Act concerning real property",
approved | ||||||
| 5 | August 1, 2007, Public Act 95-19, is amended by changing | ||||||
| 6 | Sections 5 and 10 as follows:
| ||||||
| 7 | (P.A. 95-19, Sec. 5)
| ||||||
| 8 | Sec. 5. Legislative declaration. The General Assembly | ||||||
| 9 | declares that the State of Illinois has surplus real property | ||||||
| 10 | situated in the vicinity of Weber Road and West Division Street | ||||||
| 11 | in Will County which is a parcel containing 200 acres, more or | ||||||
| 12 | less, that is located in Section 29 19, Township 36 North, | ||||||
| 13 | Range 10 East of the Third Principal Meridian in the County of | ||||||
| 14 | Will, State of Illinois, this parcel being more particularly | ||||||
| 15 | described under Section 10 of this Act, which is under the | ||||||
| 16 | control of the Department of Corrections. | ||||||

| 19 | Sec. 10. Property sale. | ||||||
| 20 | (a) The Director of Corrections, on behalf of the State of | ||||||
| 21 | Illinois and the Department of Corrections, must convey by quit | ||||||
| 22 | claim deed all right, title, and interest of the State of | ||||||

| 1 | Illinois and the Department of Corrections in and to real | ||||||
| 2 | property situated in the vicinity of Weber Road and West | ||||||
| 3 | Division Street in Will County which is a parcel containing 200 | ||||||
| 4 | acres, more or less, that is located in Section 29 19, Township | ||||||
| 5 | 36 North, Range 10 East of the Third Principal Meridian in the | ||||||
| 6 | County of Will, State of Illinois, this parcel being more | ||||||
| 7 | particularly described in a legal description to be made by an | ||||||
| 8 | Illinois professional land surveyor, the cost to be paid by the | ||||||
| 9 | purchaser, described in Section 5 to the Director of Central | ||||||
| 10 | Management Services for disposition pursuant to subsections | ||||||
| 11 | (a), (d), and (e) of Section 7.1 of the State Property Control | ||||||
| 12 | Act. | ||||||
| 13 | (b) Notwithstanding the provision in subsection (d) of | ||||||
| 14 | Section 7.1 of the State Property Control Act that requires | ||||||
| 15 | that moneys received for the sale of surplus property be | ||||||
| 16 | deposited in the General Revenue Fund, all moneys received from | ||||||
| 17 | the sale of the surplus real property under this Section shall | ||||||
| 18 | be deposited into the Road Fund. | ||||||

| 20 | Section 99. Effective date. This Act takes effect upon | ||||||
| 21 | becoming law.
