| less in a nursing facility can successfully return to the |

| community without experiencing unnecessary |

| institutionalization. The initial pilot program sites shall be |
4 |
| those initiated or operated by the Department in Fiscal Year |
5 |
| 2009. The pilot program may be expanded to other sites as |
6 |
| funding becomes available for that purpose. |
7 |
| (b) The Department of Human Services shall secure the |
8 |
| cooperation of hospitals in the geographic areas served by the |
9 |
| pilot program so that hospitals will coordinate with the |
10 |
| Service Coordination Agencies and the Home Services Program to |
11 |
| verify whether the individual is expected to have a short-term |
12 |
| stay of 6 months or less in a nursing facility upon discharge |
13 |
| from the hospital. |
14 |
| (c) The Service Coordination Agencies and the Home Services |
15 |
| Program in the pilot areas shall make an initial assessment and |
16 |
| a post-admission assessment to ascertain whether an individual |
17 |
| needs a nursing facility level of care and whether the |
18 |
| individual is expected to be in the nursing facility for a |
19 |
| short-term stay of 6 months or less. |
20 |
| (d) The Service Coordination Agencies and the Home Services |
21 |
| Program shall make necessary and appropriate efforts to |
22 |
| reintegrate any individual who is found to need nursing |
23 |
| facility level of care and is expected to be in a nursing home |
24 |
| for a short-term stay of 6 months or less, including |
25 |
| collaboration with local service providers, such as centers for |
26 |
| independent living and community mental health agencies. |

| (e) If an individual who, through the pilot program, has |
2 |
| been identified as needing a short-term stay of 6 months or |
3 |
| less is admitted to a nursing facility, the individual shall be |
4 |
| assessed for eligibility for an enhanced Community Home |
5 |
| Maintenance Allowance to allow the individual to retain income |
6 |
| for a period of up to 6 months in order to retain his or her |
7 |
| home. |
8 |
| (f) The pilot program shall operate for not less than 3 |
9 |
| years after the effective date of this amendatory Act of the |
10 |
| 96th General Assembly. The Department of Human Services shall |
11 |
| assess the effectiveness of the pilot program in preventing the |
12 |
| unnecessary institutionalization of individuals with physical |
13 |
| disabilities or mental illness and allowing them to |
14 |
| successfully return to their pre-admission living |
15 |
| arrangements. |
16 |
| (g) The pilot program established under this Article shall |
17 |
| not apply to facilities that qualify under federal law as |
18 |
| institutions for mental disease.

| Section 99. Effective date. This Act takes effect upon |
20 |
| becoming law.".
