SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/5-1035.3 new

    Amends the Counties Code. Authorizes a county, by ordinance or resolution adopted by the county board or by referendum, to opt out of any tax imposed within the county. If a county opts out of a tax, then the tax shall no longer be imposed or collected in the county and the county shall no longer receive distributions or any other benefits derived from the imposition of the tax.

1     AN ACT concerning counties.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 5-1035.3 as follows:
 
6     (55 ILCS 5/5-1035.3 new)
7     Sec. 5-1035.3. Tax opt out.
8     (a) A county, by ordinance or resolution adopted by the
9 county board or by referendum, may opt out of any tax imposed
10 within the county. If a county opts out of a tax, then the tax
11 shall no longer be imposed or collected in the county and the
12 county shall no longer receive distributions or any other
13 benefits derived from the imposition of the tax.
14     (b) The county board, by resolution, may provide for the
15 submission to the electors the question of whether the county
16 shall opt out of a tax. The board shall certify the resolution
17 and proposition to the proper election officials, who shall
18 submit the question to the electors at the consolidated or
19 general election next occurring and in accordance with the
20 general election law. The proposition shall be in substantially
21 the following form:
22         Shall the County of (insert name of county) opt out of
23     (insert description of tax)?

1     The votes shall be recorded as "Yes" or "No".
2     If a majority of the electors voting on the proposition
3 vote in favor of it, then the county has opted out of the tax.
