AMENDMENT TO HOUSE BILL 2516

2     AMENDMENT NO. ______. Amend House Bill 2516, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Counties Code is amended by adding Section
6 5-1035.3 as follows:
 
7     (55 ILCS 5/5-1035.3 new)
8     Sec. 5-1035.3. Tax increase opt out.
9     (a) A county, by ordinance or resolution adopted by the
10 county board or by referendum, may opt out of any tax increase
11 imposed pursuant to Section 4.03 of the Regional Transportation
12 Act, as amended by Public Act 95-708, and to be used by the
13 county as provided in Section 4.03.3 of that Act. If a county
14 opts out of a tax increase, then the tax increase shall no
15 longer be imposed or collected in the county and the county
16 shall no longer receive distributions or any other benefits

1 derived from the imposition of the tax increase.
2     (b) The county board, by resolution, may provide for the
3 submission to the electors the question of whether the county
4 shall opt out of a tax increase. The board shall certify the
5 resolution and proposition to the proper election officials,
6 who shall submit the question to the electors at the
7 consolidated or general election next occurring and in
8 accordance with the general election law. The proposition shall
9 be in substantially the following form:
10         Shall the County of (insert name of county) opt out of
11     (insert description of tax increase)?
12     The votes shall be recorded as "Yes" or "No".
13     If a majority of the electors voting on the proposition
14 vote in favor of it, then the county has opted out of the tax
15 increase.
16     (c) A county may not opt out of any tax increase under this
17 Section if the proceeds are pledged to make principal or
18 interest payments on bonds or other long-term debt.
 
19     Section 99. Effective date. This Act takes effect upon
20 becoming law.".
