SYNOPSIS AS INTRODUCED:

P.A. 95-631, Sec. 75

Amends Public Act 95-631 by correcting part of the legal description. Authorizes the Department of Transportation to convey described parcels in Jefferson, Madison, Saline, Sangamon, St. Clair, and Tazewell counties. Authorizes the Department of Transportation to release or restore various described easements acquired by the State for highway purposes in DeKalb, Grundy, Ogle, Rock Island, and Woodford counties. Effective immediately.

AN ACT concerning land.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. "An Act concerning State government", approved September 25, 2007, Public Act 95-631, is amended by changing Section 75 as follows:

Sec. 75. Upon the payment of the sum of $46,541.67 to the State of Illinois, and subject to the conditions set forth in Section 900 of this Act, the easement for highway purposes acquired by the People of the State of Illinois is released over and through the following described land in Grundy County, Illinois:

Parcel No. 3LR0101

Part of the Northeast Quarter and part of the Southeast Quarter of Section 8, Township 31 North, Range 8 East of the Third Principal Meridian described as follows:

Section 10. Upon the payment of the sum of $21,600.00 to the State of Illinois, and subject to the conditions set forth in Section 900 of this Act, the Secretary of the Department of Transportation is authorized to convey by quitclaim deed all right, title and interest in and to the following described land in Tazewell County, Illinois, to Jerry Eckstein.

Part of Lot 48 in Cincinnati Addition to the Original Town, now City of Pekin, Tazewell County, State of Illinois.

Commencing at the northeast corner of said Lot 48 as a Point of Beginning;

Thence South 00 degrees 35 minutes 52 seconds East (bearings assumed for description purposes only), along the east line of said Lot 48, a distance of 56.05 feet to a point 10.00 feet perpendicularly distant north of the south line of said lot; thence South 89 degrees 26 minutes 46 seconds West parallel with said south line, a distance of 112.73 feet to a point 27.50 feet perpendicularly distant east of the centerline of said F.A.P. Part of Lots 59 and 60 of the First Addition to Fairfield Annex, according to the plat thereof recorded April 8, 1937 in Plat Book 17, Page 44 and being located in the Northeast Quarter of Section 11, Township 5 North, Range 9 West of the Third Principal Meridian, Madison County, Illinois, described as follows:

Commencing at the southwest corner of said Lot 59; thence on an assumed bearing of North 01 degree 40 minutes 19 seconds West, on the westerly line of said Lot 59, a distance of 178.79 feet to the Point of Beginning.

From said Point of Beginning; thence North 01 degree 40 minutes 19 seconds West, on said westerly line of Lot 59, a distance of 33.44 feet; thence South 84 degrees 29 minutes 24 seconds East, 115.29 feet; thence southeasterly, 36.11 feet on a curve to the right, having a radius of 25.00 feet, the chord of said curve bears South 43 degrees 06 minutes 33 seconds East, 33.05 feet; thence South 01 degree 43 minutes 42 seconds East, on the easterly line of said Lot 60, a distance of 11.17 feet; thence North 84 degrees 35 minutes 43 seconds West, a distance of 137.32 feet to the Point of Beginning.

Section 20. Upon the payment of the sum of $4,166.67 to the State of Illinois, and subject to the conditions set forth in Section 900 of this Act, the Secretary of the Department of Transportation is authorized to convey by quitclaim deed all right, title and interest in and to the following described land in St. Clair County, Illinois, to Randy Walta.

That part of Lot 3 in the Northeast Quarter of the Northwest Quarter of Section 2, Township 3 South, Range 7 West of the Third Principal Meridian, St. Clair County, Illinois, reference being had to the plat thereof recorded in Book of Plats "C", on Page 157 in the Recorder's Office of St. Clair County, Illinois, described as follows:

Commencing at the point of intersection of the survey centerline of F.A. Route 14 (Illinois Route 13) and the southwesterly right-of-way line of the Illinois Central Railroad; thence on an assumed bearing of North 50 degrees 21 minutes 40 seconds West on said southwesterly right-of-way line, 470.89 feet to the southeast corner of Parcel 29, Tract "X" as described in the Warranty Deed to the State of Illinois as recorded on September 2, 1970 in Book 2239, on Page 688, said southeast corner being the Point of Beginning;

Commencing at a stone at the southeast corner of the Southeast Quarter of the Northeast Quarter of said Section 2; thence North 2 degrees, 31 minutes 00 seconds West, 816.07 feet along the east line of said Southeast Quarter of the Northeast Quarter of said Section 2 to a point on the survey centerline of a highway known as F.A. It is understood and agreed that there is no existing right of access nor will access be permitted in the future by the State of Illinois, Department of Transportation, from or over the premises above described to and from IL Route 13, previously declared a freeway.

Section 25. Upon the payment of the sum of $2,500.00 to the State of Illinois, and subject to the conditions set forth in Section 900 of this Act, the Secretary of the Department of Transportation is authorized to convey by quitclaim deed all right, title and interest in and to the following described land in Jefferson County, Illinois, to Marc and Allison Harris.

A part of Lots 15 and 16 in George D. Williams' Fourth Addition to the City of Mt. Vernon, Illinois, situated in Jefferson County, Illinois, more particularly described as follows: Commencing at a point on the southerly line of Lot 16 of said George D. The above described parcel contains 0.069 acres (3000.00 sq. ft.), more or less.

All distances measured from the centerline of FAU. 8736 (Illinois Route 37) are measured normal to said centerline.

The basis of the bearings in this description is the Illinois State Plane Coordinate System.

Section 30. Upon the payment of the sum of $4,200.00 to the State of Illinois, and subject to the conditions set forth in Section 900 of this Act, the Secretary of the Department of Transportation is authorized to convey by quitclaim deed all right, title and interest in and to the following described land in Sangamon County, Illinois, to Golds Gym of Springfield.

Part of Lots 1 and 2 in Block 2 in Hickox and Chestnut's Addition to the City of Springfield, described more particularly as follows:

Commencing at an iron pipe marking the southwest corner of Block 1 in Hickox and Chestnut's Addition, thence North 89 degrees 02 minutes 45 seconds West along the north line of Washington Street a distance of 16.52 feet, thence North 62 degrees 31 minutes 35 seconds West, a distance of 61.73 feet to a point on the east line of Block 2 in Hickox and Chestnut's Addition, said point marks the true Point of Beginning, thence continuing North 62 degrees 31 minutes 35 seconds West, a distance of 75.54 feet to an iron pipe, thence North 72 degrees 28 minutes 25 seconds East a distance of 19.80 feet to an iron pipe, thence North 27 degrees 28 minutes, 25 seconds East a distance of 68.31 feet to an iron pipe marking the beginning of a 169.00 foot radius curve to the left, thence northeasterly 44.81 feet along said curve, having a long chord which bears North 19 degrees 52 minutes 38 seconds East for a distance of 44.68 feet to a drill hole on the east line of Block 2 in Hickox and Chestnut's Addition. Thence South 00 degrees 34 minutes 25 seconds East along said east line a distance of 143.45 feet to the True Point of Beginning. Commencing at an iron pipe marking the southwest corner of Block 1 in Hickox and Chestnut's Addition, thence North 89 degrees 02 minutes 45 seconds West along the north line of Washington Street a distance of 16.52 feet, thence North 62 degrees 31 minutes 35 seconds West, a distance of 41.73 feet to the true Point of Beginning, thence continuing North 62 degrees 31 minutes 35 seconds West, a distance of 72.24 feet, thence North 26 degrees 42 minutes 08 seconds East a distance of 28.01 feet, thence South 64 degrees 56 minutes 10 seconds East a distance of 36.90 feet, thence South 22 degrees 56 minutes 29 seconds East a distance of 46.38 feet to the True Point of Beginning. Said parcel contains 1584 square feet (0.036 acre) more or less, all in the County of Sangamon, State of Illinois.

Upon the payment of the sum of $4,500.00 to the State of Illinois, and subject to the conditions set forth in Section 900 of this Act, the Secretary of the Department of Transportation is authorized to convey by quitclaim deed the rights of access to the following described land in Saline County, Illinois, to Wayne Head and Martha Head, as joint tenants with right of survivorship.

In the northeast quarter of the northwest quarter of Section 15, T9S, R7E, 3rd P.M. on Illinois Route 13, Saline County, IL, where the access shall be changed from a farming purposes only to a single family residence and/or farming purposes only entrance centered at Station 1397+00 left to a maximum total width of 40 feet.

Section 900. The Secretary of Transportation shall obtain a certified copy of the portion of this Act containing the title, enacting clause, the effective date, the appropriate Section containing the land description of the property to be transferred or otherwise affected under this Act within 69 days after its effective date and, upon receipt of payment required by the Section shall record the certified document in the Recorder's Office in the county in which the land is located.

Section 999. Effective date. This Act takes effect upon becoming law.
