| AN ACT concerning animals.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|

| Section 5. The Animal Control Act is amended by changing |
| 5 |
| Section 18.1 as follows:
|
| 6 |
| (510 ILCS 5/18.1) (from Ch. 8, par. 368.1)
|

| Sec. 18.1.
|
| 8 |
| (a) The owner or keeper of a dog is liable to a person for |
| 9 |
| all
damages caused by the dog pursuing, chasing, worrying, |
| 10 |
| wounding, injuring,
or killing any sheep, goats, cattle, |
| 11 |
| horses, mules, poultry, ratites, or
swine, or companion animals
|
| 12 |
| belonging to that person.
|
| 13 |
| (b) The dog's owner or keeper may raise as an affirmative |
| 14 |
| defense to a violation of subsection (a) of this Section any of |
| 15 |
| the following: |
| 16 |
| (1) The negligence of the person who owns or is responsible |
| 17 |
| for the injured animal. |
| 18 |
| (2) The provocation of the dog by the injured animal. |

| Section 99. Effective date. This Act takes effect upon |
| 21 |
| becoming law.
