SYNOPSIS AS INTRODUCED:
 
420 ILCS 44/30

    Amends the Radon Industry Licensing Act. Provides that persons who perform testing for radon or radon progeny must report the results of that testing to their clients, owners or occupants (under certain circumstances), and the Nuclear Safety Division of the Illinois Emergency Management Agency (now, just to clients and (under certain circumstances) owners or occupants). Requires the Agency to report certain radon testing results to municipalities or counties.

1     AN ACT concerning safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Radon Industry Licensing Act is amended by
5 changing Section 30 as follows:
 
6     (420 ILCS 44/30)
7     Sec. 30. Reporting of information. Within 45 days after
8 testing for radon or radon progeny, a person performing the
9 testing shall report the results of the testing to his or her
10 client and the Nuclear Safety Division of the Agency. If the
11 results of the testing indicate radon concentrations at or
12 above 4 picocuries per liter (pCi/L) and the testing location
13 is located within a municipality, then the Agency must report
14 the results of that testing to that municipality. If the
15 results of the testing indicate radon concentrations at or
16 above 4 picocuries per liter (pCi/L) and the testing location
17 is not located within a municipality, then the Agency must
18 report the results of that testing to the county in whose
19 jurisdiction the radon testing was performed. the results of
20 the testing. In addition, if the client is not the owner or
21 occupant of the building, a person shall report to the owner or
22 occupant upon request. To the extent that the testing results
23 contain information pertaining to the medical condition of an

1 identified individual or the concentration of radon or radon
2 progeny in an identified dwelling, information obtained by the
3 Agency pursuant to this Act is exempt from the disclosure
4 requirements of the Freedom of Information Act, except that the
5 Agency shall make the information available to the identified
6 individual or the owner or occupant on request.
