AMENDMENT TO HOUSE BILL 3844

    AMENDMENT NO. ______. Amend House Bill 3844 as follows:

on page 5, by replacing lines 12 through 14 with the following:

"harm. "Physical abuse" includes actions that cause bodily harm 
5
as a result of an employee directing an individual or person to 
6
physically abuse another individual."; and
 
7
on page 6, line 2, immediately after "in" by inserting "sexual 
8
behavior that results in"; and
 
9
on page 21, line 14, by replacing "may" with "shall"; and
 
10
on page 26, by replacing line 13 with  the following: 
11
"statement. Nothing in this subdivision (s)(2) shall diminish 
12
or impair the rights of a person who is a member of a 
13
collective bargaining unit under the Illinois Public Labor 
14
Relations Act or under any other federal labor statute."; and

by replacing page 27, line 25 through page 28, line 4 with the

following:

"bargaining agreement. If an action taken by an employer 
4
against an employee as a result of a finding of physical abuse, 
5
sexual abuse, or egregious neglect is overturned through an 
6
action filed with the Illinois Civil Service Commission or 
7
under any applicable collective bargaining agreement and if 
8
that employee's name has already been sent to the registry, the 
9
employee's name shall be removed from the registry."; and
 
10
on page 32, line 11, immediately after "allegations", by 
11
inserting ", the timeliness of the Office of the Inspector 
12
General's investigations,".
