AMENDMENT TO HOUSE BILL 3861

    AMENDMENT NO. ______. Amend House Bill 3861  by replacing

everything after the enacting clause with the following:

    "Section 5. The Illinois Insurance Code is amended  by 
5
adding Section 370u as follows:

    (215 ILCS 5/370u  new)
7
    Sec. 370u. Non-contracted health care providers. A group or 
8
individual policy of accident and health insurance amended, 
9
delivered, issued, or renewed in this State after the effective 
10
date of this amendatory Act of the 96th General Assembly  that 
11
provides incentives for insureds, enrollees, or beneficiaries 
12
to seek services from contracted providers must ensure that 
13
when an insured, enrollee, or beneficiary has received insurer 
14
approval to utilize a contracted provider for covered services 
15
and, due to a lack of reasonable and equitable access to 
16
contracted providers, the services are provided by a

non-contracted provider, the covered service is provided at no 
2
greater cost to the insured, enrollee, or beneficiary than had 
3
the service been provided by a contracted provider.".
