SYNOPSIS AS INTRODUCED:
 
20 ILCS 510/65.9 new

    Amends the Department of Children and Family Services Powers Law of the Civil Administrative Code of Illinois. Requires the Department to develop and implement policies and procedures requiring the drug testing of (i) State employed caseworkers and other Department employees who may provide direct services to children and families and (ii) applicants for positions in the Department that may involve providing direct services to children and families. Requires these drug testing policies and procedures to be developed in consultation with representatives of the organizations that represent the Department's employees during collective bargaining and to be complied with by private welfare agencies as a condition to their receipt of State funding for child welfare services.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Children and Family Services
5 Powers Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 65.9 as follows:
 
7     (20 ILCS 510/65.9 new)
8     Sec. 65.9. Employee drug testing. To ensure the health and
9 safety of children and families, the Department of Children and
10 Family Services shall develop and implement policies and
11 procedures requiring the drug testing of (i) State employed
12 caseworkers and other Department employees who may provide
13 direct services to children and families and (ii) applicants
14 for any positions in the Department that may involve providing
15 direct services to children and families. The Department shall
16 develop drug testing policies and procedures in consultation
17 with representatives of the organizations that represent
18 Department employees during collective bargaining. The drug
19 testing policies and procedures shall also be complied with by
20 private child welfare agencies as a condition to their receipt
21 of State funding for child welfare services.
