| AMENDMENT NO. ______. Amend House Bill 4182 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Department of Central Management Services |
5 |
| Law of the
Civil Administrative Code of Illinois is amended by |
6 |
| adding Section 405-296 as follows: |
7 |
| (20 ILCS 405/405-296 new) |
8 |
| Sec. 405-296. Clean coal facilities. The Department must |
9 |
| purchase, on an annual basis and at a rate that covers |
10 |
| operating costs and debt service plus the value of any |
11 |
| allowances, credits, benefits, or incentives that accrue from |
12 |
| the capture and storage of carbon, but does not exceed the rate |
13 |
| approved for the initial clean coal facility, the full |
14 |
| electrical output of a clean coal facility located in Illinois: |
15 |
| (1) that has a nameplate capacity of at least 200 |
16 |
| megawatts; |

| (2) that has carbon capture and sequestration |
2 |
| technology; |
3 |
| (3) that has been developed in partnership with the |
4 |
| United States Department of Energy; and |
5 |
| (4) for which the Department of Energy: |

| (A) has completed an Environmental Impact |
7 |
| Statement; and |
8 |
| (B) has issued a Record of Decision on or before |
9 |
| the effective date of this Section. |
10 |
| Procurements under this Section are not subject to the |
11 |
| Illinois Procurement Code. |
12 |
| Section 10. The Illinois Procurement Code is amended by |
13 |
| changing Section 50-70 as follows:

| (30 ILCS 500/50-70)
|
15 |
| Sec. 50-70. Additional provisions. This Code is subject
to |
16 |
| applicable provisions of
the following Acts :
|
17 |
| (1) Article 33E of the Criminal Code of 1961;
|
18 |
| (2) the Illinois Human Rights Act;
|
19 |
| (3) the Discriminatory Club Act;
|
20 |
| (4) the Illinois Governmental Ethics Act;
|
21 |
| (5) the State Prompt Payment Act;
|
22 |
| (6) the Public Officer Prohibited Activities Act;
|
23 |
| (7) the Drug Free Workplace Act;
|
24 |
| (8) the Illinois Power Agency Act; and
|
