SYNOPSIS AS INTRODUCED:

    Provides that the Act may be referred to as the Brandon Ballard Law. Amends the School Code and the Critical Health Problems and Comprehensive Health Education Act. Provides that a school board shall require that high school students participating in interscholastic athletics have a hernia check performed before being allowed to participate. Provides that a school board shall require that any pre-participation physical examination form a student must have completed before participating in interscholastic athletics include the question of whether the student's family has a medical history of cancer. Provides that the Comprehensive Health Education Program must include, in grades 9 through 12, instruction on testicular cancer. Effective July 1, 2009.

1     AN ACT concerning education, which may be referred to as
2 the Brandon Ballard Law.
 
3     Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
 
5     Section 5. The School Code is amended by adding Sections
6 10-20.46, 10-20.47, 34-18.37, and 34-18.38 as follows:
 
7     (105 ILCS 5/10-20.46 new)
8     Sec. 10-20.46. Student athletes; hernia check. A school
9 board shall require that high school students participating in
10 interscholastic athletics have a hernia check performed before
11 being allowed to participate.

14     Section 10. The Critical Health Problems and Comprehensive
15 Health Education Act is amended by changing Section 3 as
16 follows:

18     Sec. 3. Comprehensive Health Education Program. The
19 program established under this Act shall include, but not be
20 limited to, the following major educational areas as a basis
21 for curricula in all elementary and secondary schools in this
22 State: human ecology and health, including instruction in
23 grades 9 through 12 on testicular cancer, human growth and

1 development, the emotional, psychological, physiological,
2 hygienic and social responsibilities of family life, including
3 sexual abstinence until marriage, prevention and control of
4 disease, including instruction in grades 6 through 12 on the
5 prevention, transmission and spread of AIDS, sexual assault
6 awareness in secondary schools, public and environmental
7 health, consumer health, safety education and disaster
8 survival, mental health and illness, personal health habits,
9 alcohol, drug use, and abuse including the medical and legal
10 ramifications of alcohol, drug, and tobacco use, abuse during
11 pregnancy, sexual abstinence until marriage, tobacco,
12 nutrition, and dental health. The program shall also provide
13 course material and instruction to advise pupils of the
14 Abandoned Newborn Infant Protection Act. Notwithstanding the
15 above educational areas, the following areas may also be
16 included as a basis for curricula in all elementary and
17 secondary schools in this State: basic first aid (including,
18 but not limited to, cardiopulmonary resuscitation and the
19 Heimlich maneuver), early prevention and detection of cancer,
20 heart disease, diabetes, stroke, and the prevention of child
21 abuse, neglect, and suicide.
22     The school board of each public elementary and secondary
23 school in the State shall encourage all teachers and other
24 school personnel to acquire, develop, and maintain the
25 knowledge and skills necessary to properly administer
26 life-saving techniques, including without limitation the

1 Heimlich maneuver and rescue breathing. The training shall be
2 in accordance with standards of the American Red Cross, the
3 American Heart Association, or another nationally recognized
4 certifying organization. A school board may use the services of
5 non-governmental entities whose personnel have expertise in
6 life-saving techniques to instruct teachers and other school
7 personnel in these techniques. Each school board is encouraged
8 to have in its employ, or on its volunteer staff, at least one
9 person who is certified, by the American Red Cross or by
10 another qualified certifying agency, as qualified to
11 administer first aid and cardiopulmonary resuscitation. In
12 addition, each school board is authorized to allocate
13 appropriate portions of its institute or inservice days to
14 conduct training programs for teachers and other school
15 personnel who have expressed an interest in becoming qualified
16 to administer emergency first aid or cardiopulmonary
17 resuscitation. School boards are urged to encourage their
18 teachers and other school personnel who coach school athletic
19 programs and other extracurricular school activities to
20 acquire, develop, and maintain the knowledge and skills
21 necessary to properly administer first aid and cardiopulmonary
22 resuscitation in accordance with standards and requirements
23 established by the American Red Cross or another qualified
24 certifying agency. Subject to appropriation, the State Board of
25 Education shall establish and administer a matching grant
26 program to pay for half of the cost that a school district

1 incurs in training those teachers and other school personnel
2 who express an interest in becoming qualified to administer
3 cardiopulmonary resuscitation (which training must be in
4 accordance with standards of the American Red Cross, the
5 American Heart Association, or another nationally recognized
6 certifying organization) or in learning how to use an automated
7 external defibrillator. A school district that applies for a
8 grant must demonstrate that it has funds to pay half of the
9 cost of the training for which matching grant money is sought.
10 The State Board of Education shall award the grants on a
11 first-come, first-serve basis.
12     No pupil shall be required to take or participate in any
13 class or course on AIDS or family life instruction if his
14 parent or guardian submits written objection thereto, and
15 refusal to take or participate in the course or program shall
16 not be reason for suspension or expulsion of the pupil.
17     Curricula developed under programs established in
18 accordance with this Act in the major educational area of
19 alcohol and drug use and abuse shall include classroom
20 instruction in grades 5 through 12. The instruction, which
21 shall include matters relating to both the physical and legal
22 effects and ramifications of drug and substance abuse, shall be
23 integrated into existing curricula; and the State Board of
24 Education shall develop and make available to all elementary
25 and secondary schools in this State instructional materials and
26 guidelines which will assist the schools in incorporating the

1 instruction into their existing curricula. In addition, school
2 districts may offer, as part of existing curricula during the
3 school day or as part of an after school program, support
4 services and instruction for pupils or pupils whose parent,
5 parents, or guardians are chemically dependent.

8     Section 99. Effective date. This Act takes effect July 1,
9 2009.
