| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Mercury-Free Vaccine Act is amended by |
5 |
| changing Section 5 as follows: |

| (410 ILCS 51/5)
|

| Sec. 5. Banned mercury-containing vaccines. |
8 |
| (a) Commencing January 1, 2006, a person shall not be |
9 |
| vaccinated with a mercury-containing vaccine , including, but |
10 |
| not limited to, an H1N1 influenza vaccine, that contains more |
11 |
| than 1.25 micrograms of mercury per dose.
|
12 |
| (b) Commencing January 1, 2008, no person shall be |
13 |
| vaccinated with a vaccine , including, but not limited to, an |
14 |
| H1N1 influenza vaccine, or injected with any product that |
15 |
| contains, or prior to dilution, had contained as an additive, |
16 |
| any mercury based product, whether at preservative or trace |
17 |
| amount levels.

| (c) The Department of Public Health shall implement a |
19 |
| policy to distribute,
preferentially, influenza vaccines , |
20 |
| including, but not limited to, an H1N1 influenza vaccine, that |
21 |
| are thimerosal-free or contain only trace
amounts of thimerosal |
22 |
| for the immunization of children under the age of 3
who are |
23 |
| participating in the Vaccines for Children program, provided |
