2 | AMENDMENT NO. ______. Amend House Bill 4711, AS AMENDED, by | ||||||
3 | replacing everything after the enacting clause with the | ||||||
4 | following:
| ||||||
5 | "Section 5. The School Code is amended by adding Section | ||||||
6 | 22-60 as follows: | ||||||
7 | (105 ILCS 5/22-60 new) | ||||||
8 | Sec. 22-60. Unfunded mandates prohibited. | ||||||
9 | (a) No public school district or private school is | ||||||
10 | obligated to comply with any statutory or regulatory mandate or | ||||||
11 | requirement unless a separate appropriation has been enacted | ||||||
12 | into law providing funding for the school year during which | ||||||
13 | such mandate is required. | ||||||
14 | (b) If the amount appropriated to fund a statutory or | ||||||
15 | regulatory mandate or requirement is insufficient to fully fund | ||||||
16 | the mandated activity, then the school district or private |

1 | school may choose to discontinue or modify the mandated | ||||||
2 | activity to ensure that the costs of compliance do not exceed | ||||||
3 | the funding received. Official action by the school board of a | ||||||
4 | school district or governing entity of a private school must | ||||||
5 | take place before the school district or private school may | ||||||
6 | discontinue or modify a mandated activity due to insufficient | ||||||
7 | funding from the State. If a school district or private school | ||||||
8 | discontinues or modifies a mandated activity due to | ||||||
9 | insufficient funding from the State, then the school district | ||||||
10 | or private school shall annually maintain and update a list of | ||||||
11 | discontinued or modified mandated activities. The list shall be | ||||||
12 | provided to the State Board of Education upon request. | ||||||
13 | (c) This Section does not apply to special education, | ||||||
14 | transportation, lunch programs, coursework required for high | ||||||
15 | school graduation, the health/life safety code, driver | ||||||
16 | education, curricula associated with Illinois learning | ||||||
17 | standards and State assessments (including longitudinal data | ||||||
18 | systems), teacher certification requirements, programs | ||||||
19 | impacted by federal requirements, laws related to teacher | ||||||
20 | tenure, evaluation, dismissal, or reduction in force, locally | ||||||
21 | negotiated contracts, bilingual education, criminal history | ||||||
22 | records checks, the Open Meetings Act, requirements for school | ||||||
23 | districts certified to be in financial difficulty under Section | ||||||
24 | 1A-8 of this Code, requirements for school districts under a | ||||||
25 | financial oversight panel or a school finance authority, and | ||||||
26 | any laws related to employment under Chapter 820 of the |

2 | Section 99. Effective date. This Act takes effect upon | ||||||
3 | becoming law.".
