1 | AMENDMENT TO HOUSE BILL 4805

2 | AMENDMENT NO. ______. Amend House Bill 4805 on page 2, by | ||||||
3 | replacing line 6 through line 15 with the following: | ||||||
4 | "Any civil penalties collected in a court proceeding shall | ||||||
5 | be deposited into : | ||||||
6 | (1) the a delegated county lead poisoning screening, | ||||||
7 | prevention, and abatement fund of the delegate agency | ||||||
8 | conducting the environmental investigation; or , | ||||||
9 | (2) the lead
poisoning screening, prevention, and | ||||||
10 | abatement fund maintained by the delegate agency | ||||||
11 | conducting the environmental investigation that has
| ||||||
12 | jurisdiction where the violation occurred. | ||||||
13 | If if no delegated county or delegate agency lead poisoning | ||||||
14 | screening, prevention, and abatement fund exists, then any | ||||||
15 | civil penalties collected in a court proceeding shall be | ||||||
16 | deposited into the Lead Poisoning Screening, Prevention, and | ||||||
17 | Abatement Fund established under Section 7.2.".
