AMENDMENT TO HOUSE BILL 4864

2     AMENDMENT NO. ______. Amend House Bill 4864 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Professional Counselor and Clinical
5 Professional Counselor Licensing Act is amended by changing
6 Section 45 as follows:
 
7     (225 ILCS 107/45)
8     (Section scheduled to be repealed on January 1, 2013)
9     Sec. 45. Qualifications for a license.
10     (a) Professional counselor. A person is qualified to be
11 licensed as a licensed professional counselor, and the
12 Department shall issue a license authorizing the practice of
13 professional counseling to an applicant who:
14         (1) has applied in writing on the prescribed form and
15     has paid the required fee;
16         (2) is at least 21 years of age and has not engaged in

1     conduct or activities which would constitute grounds for
2     discipline under this Act;
3         (3) is a graduate of:
4             (A) a master's or doctoral level program in the
5         field of counseling, rehabilitation counseling,
6         psychology, or similar degree program approved by the
7         Department; or
8             (B) in the case of an applicant who applies for
9         licensure before the effective date of this amendatory
10         Act of the 96th General Assembly, an approved
11         baccalaureate program in human services or similar
12         degree program approved by the Department and can
13         document the equivalent of 5 years of full-time
14         satisfactory supervised experience, as established by
15         rule, under a qualified supervisor;
16         (4) has passed an examination for the practice of
17     professional counseling as authorized by the Department;
18     and
19         (5) has paid the fees required by this Act.
20     Any person who has received certification by any State or
21 national organization whose standards are accepted by the
22 Department as being substantially similar to the standards in
23 this Act may apply for a professional counselor license and
24 need not be examined further.
25     (b) Clinical professional counselor. A person is qualified
26 to be licensed as a clinical professional counselor, and the

1 Department shall issue a license authorizing the practice of
2 clinical professional counseling to an applicant who:
3         (1) has applied in writing on the prescribed form and
4     has paid the required fee;
5         (2) is at least 21 years of age and has not engaged in
6     conduct or activities which would constitute grounds for
7     discipline under this Act;
8         (3) is a graduate of:
9             (A) a master's level program in the field of
10         counseling, rehabilitation counseling, psychology, or
11         similar degree program approved by the Department and
12         has completed the equivalent of 2 years full-time
13         satisfactory supervised employment or experience
14         working as a clinical counselor under the direction of
15         a qualified supervisor subsequent to the degree; or
16             (B) a doctoral program in the field of counseling,
17         rehabilitation counseling, psychology, or similar
18         program approved by the Department and has completed
19         the equivalent of 2 years full-time satisfactory
20         supervised employment or experience working as a
21         clinical counselor under the direction of a qualified
22         supervisor, at least one year of which is subsequent to
23         the degree;
24         (4) has passed the examination for the practice of
25     clinical professional counseling as authorized by the
26     Department; and

1         (5) has paid the fees required by this Act.
2     Any person who has received certification by any State or
3 national organization whose standards are accepted by the
4 Department as being substantially similar to the standards in
5 this Act may apply for a clinical professional counselor
6 license, and need not be examined further.
7     (c) Examination for applicants under this Act shall be held
8 at the discretion of the Department from time to time but not
9 less than once each year. The examination used shall be
10 authorized by the Department.
11     (d) Upon application and payment of the required fee, an
12 applicant who has an active license as a clinical psychologist
13 or a clinical social worker licensed under the laws of this
14 State may, without examination, be granted registration as a
15 licensed clinical professional counselor by the Department.

17     Section 99. Effective date. This Act takes effect upon
18 becoming law.".
