1 | AN ACT concerning aging.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:

5 | Section 5. The Prevention of Unnecessary | ||||||
6 | Institutionalization Act is amended by repealing Section 35. | ||||||
7 | Section 10. The Community Senior Services and Resources Act | ||||||
8 | is amended by changing Sections 15, 20, and 32 as follows:

| ||||||
10 | Sec. 15. Definitions. For the purposes of this Act:
| ||||||
11 | "Advisory Committee" means the Community Senior Services | ||||||
12 | and Resource
Center
Advisory Committee created under Section | ||||||
13 | 35.
| ||||||
14 | "Center" means a community senior services and resource | ||||||
15 | center.
| ||||||
16 | "Department" means the Department on Aging.
| ||||||
17 | "Director" means the Director of Aging.
| ||||||
18 | "Senior" means an individual 60 years of age or older.
| ||||||
19 | "Home or community based services" includes the following: | ||||||
20 | elder
abuse; home-delivered meals; case management; wellness | ||||||
21 | and fitness programs;
counseling;
adult
day services; respite | ||||||
22 | care; senior benefits outreach; congregate meals;
long-term |

| |||||||
1 | care
ombudsman services; job training and placement; | ||||||
2 | transportation; chore homemaker
services;
caregiver support; | ||||||
3 | computer literacy; and any program that assists participants
in
| ||||||
4 | avoiding inappropriate institutional placement or addresses | ||||||
5 | participants'
health, safety,
or well-being, regardless of | ||||||
6 | whether the service is received in a
participant's home
or in | ||||||
7 | an institutional setting and a majority of participants are | ||||||
8 | seniors or
family of seniors.

| ||||||
11 | Sec. 20. Duties. The Department shall perform all of the | ||||||
12 | following
duties:
| ||||||
13 | (1) Administer this Act and promulgate any rules, | ||||||
14 | regulations,
guidelines, and
directives necessary for its | ||||||
15 | implementation.
| ||||||
16 | (2) (Blank) Establish a Community Senior Services and | ||||||
17 | Resource Center Advisory
Committee .
| ||||||
18 | (3) Make grants to non-profit agencies and units of | ||||||
19 | local government
under
Section 25
of this Act in | ||||||
20 | consultation with the Advisory Committee .
| ||||||
21 | (4) Facilitate access to government-issued bonds for | ||||||
22 | the purpose of
capital improvement.
| ||||||
23 | (5) Provide technical assistance to centers.
| ||||||
24 | (6) Develop a comprehensive list of centers and the | ||||||
25 | senior services
they offer for publication on the |

1 | Department's web site and for distribution
through other | ||||||
2 | promotional opportunities.
| ||||||
3 | (7) Develop a survey for annual distribution through | ||||||
4 | the centers to
gather information concerning the lack or | ||||||
5 | inadequacy of senior services and to
identify service
| ||||||
6 | demand trends and the unique needs of older Illinoisans and | ||||||
7 | their families.
| ||||||
8 | (8) Conduct an annual survey of centers to assess their | ||||||
9 | facility,
program, and operational needs.
| ||||||
10 | (9) Report annually in conjunction with the Advisory | ||||||
11 | Committee to the
Governor and the General Assembly. The | ||||||
12 | report shall include findings from all
surveys conducted | ||||||
13 | pursuant to this Act, a list of grantees by county | ||||||
14 | (including
amounts awarded), and recommendations | ||||||
15 | concerning the ongoing financial
stability of centers.

16 | (10) Pursue alternative funding opportunities.

19 | Sec. 32. Bequests and gifts; awareness campaign. | ||||||
20 | (a) The Director may accept monetary grants, gifts, and | ||||||
21 | bequests for
deposit into the Community Senior Services and | ||||||
22 | Resources Fund. | ||||||
23 | (b) The Director may accept monetary grants, gifts, and | ||||||
24 | bequests for the benefit of a specified center or distinct area | ||||||
25 | of the State. Each such grant, gift, or bequest shall be kept |

1 | in a distinct fund. The Department may make grants from these | ||||||
2 | funds for the purposes established for the Community Senior | ||||||
3 | Services and Resources Fund and in accordance with the terms | ||||||
4 | and conditions of the grant, gift, or bequest. These funds are | ||||||
5 | exempt from Section 8h of the State Finance Act. | ||||||
6 | (c) The Department may , in conjunction with the Community | ||||||
7 | Senior Services and Resource Center Advisory Committee, shall | ||||||
8 | design an awareness campaign that can be implemented by senior | ||||||
9 | services and resource centers at their individual expense.

17 | Section 99. Effective date. This Act takes effect upon | ||||||
18 | becoming law.
