| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|

| Section 5. The Mental Health and Developmental |
| 5 |
| Disabilities Code is amended by changing Section 1-102 as |
| 6 |
| follows:
|

| Sec. 1-102.
"Care and
and custody" means authorization to |

| an appropriate
person, with his consent, to provide or arrange |
| 10 |
| for proper and adequate
treatment of another person who is |
| 11 |
| subject to involuntary admission but
does not include the |
| 12 |
| authority to require hospitalization of the recipient
unless |
| 13 |
| such authority is expressly granted by court order pursuant to |
| 14 |
| Article
VII of Chapter III. |
