SYNOPSIS AS INTRODUCED:
 
730 ILCS 5/3-4-3.1

    Amends the Unified Code of Corrections. Provides that the Department of Corrections shall notify the immediate family members of a committed person within 90 days after the commitment of the person to an institution or facility of the Department that the Department has in its possession the driver's license, State issued identification card, social security account card, or other government issued identification documents of the committed person and that an immediate family member may be transferred possession of those documents upon request of the immediate family member.

1     AN ACT concerning corrections.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Unified Code of Corrections is amended by
5 changing Section 3-4-3.1 as follows:
 
6     (730 ILCS 5/3-4-3.1)
7     Sec. 3-4-3.1. Identification documents of committed
8 persons.
9     (a) Driver's licenses, State issued identification cards,
10 social security account cards, or other government issued
11 identification documents in possession of a county sheriff at
12 the time a person is committed to the Illinois Department of
13 Corrections shall be forwarded to the Department.
14     (a-5) The Department shall notify the immediate family
15 members of a committed person within 90 days after the
16 commitment of the person to an institution or facility of the
17 Department that the Department has in its possession the
18 driver's license, State issued identification card, social
19 security account card, or other government issued
20 identification documents of the committed person and that an
21 immediate family member may be transferred possession of those
22 documents upon request of the immediate family member.

1 request of that family member as provided in subsection (a-5),
2 the The Department shall retain the government issued
3 identification documents of a committed person at the
4 institution in which the person is incarcerated and shall
5 ensure that the documents are forwarded to any institution to
6 which the person is transferred.
7     (c) Unless transferred to an immediate family member as
8 provided in subsection (a-5), the The government issued
9 identification documents of a committed person shall be made
10 available to the person upon discharge from the Department.
11     (d) For the purposes of this Section, "immediate family
12 member" means the spouse or parent of a committed person or a
13 child of the committed person who is at least 18 years of age.
