| AMENDMENT NO. ______. Amend House Bill 5071 on page 10, by |

| replacing lines 24 through 26 with the following: |

| ""Regular employee" means a person working at a consistent |

| interval over time an average of 20 hours per week for a person |

| or entity who would be considered as an employee under the |
| 7 |
| Internal Revenue Service eleven main tests in three categories |
| 8 |
| being behavioral control, financial control and the type of |
| 9 |
| relationship of the parties, formerly the twenty factor test."; |

| and

| by deleting lines 1 through 3 on page 11.
