SYNOPSIS AS INTRODUCED:
 
70 ILCS 805/6g new

    Amends the Downstate Forest Preserve District Act. Provides that a forest preserve located within a county with a population of less than 3,000,000 may sell a parcel of land that is less than 3 acres in size if it was originally part of a larger parcel but became separated as a result of the construction of a new public road. Sets forth other criteria for the sale. Provides that the proceeds from the sale must be set aside in the forest preserve district's endowment fund and used for the district's future land acquisitions. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Downstate Forest Preserve District Act is
5 amended by adding Section 6g as follows:
 
6     (70 ILCS 805/6g new)
7     Sec. 6g. Land separated by a public road; sale. The board
8 of a forest preserve district located within a county that has
9 a population of less than 3,000,000 may sell a parcel of land
10 owned by the district that is less than 3 acres in size if the
11 parcel was originally part of a larger parcel but became
12 separated and isolated as the result of the construction of a
13 new public road. The board shall approve the sale by an
14 affirmative vote of three-fourths of the members of the board
15 then holding office. A sale may not be approved by the board
16 unless the parcel involved in the sale has been appraised by an
17 MIA appraiser or a State-certified real estate appraiser within
18 one year before the date the sale is to take effect. The net
19 proceeds from the sale of any land under this Section shall be
20 set aside in the district's Endowment Fund as provided for
21 under Section 13.7 and expended only for the district's future
22 land acquisitions and may not be used for any other purpose.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.
