Amends the Nursing Home Care Act and the Mental Health and Developmental Disabilities Code. Provides that beginning on the effective date of this amendatory Act, there shall be a 2-year moratorium on the enforcement of any new State mandate which would affect facilities or community providers unless such mandate is fully funded through a State appropriation. Effective immediately.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Nursing Home Care Act is amended by adding |
5 |
| Section 3-808 as follows: |
6 |
| (210 ILCS 45/3-808 new) |

| Sec. 3-808. Moratorium on State mandate. Beginning on the |
8 |
| effective date of this amendatory Act of the 96th General |
9 |
| Assembly, there shall be a 2-year moratorium on the enforcement |

| Section 10. The Mental Health and Developmental |

| Disabilities Code is amended by adding Section 6-104.5 as |

| follows: |
