Amends the Public Utilities Act. Provides that a public utility may amortize the cost of installing, replacing, modifying, or maintaining its facilities across all customers in the State if the installation, removal, replacement, modification, or maintenance meets specified requirements. Effective immediately.

| AN ACT concerning utilities.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by adding |
5 |
| Section 9-246 as follows: |
6 |
| (220 ILCS 5/9-246 new) |
7 |
| Sec. 9-246. Amortization over all customers; facilities. A |
8 |
| public utility may amortize the cost of installing, replacing, |
9 |
| modifying, or maintaining its facilities across all customers |
10 |
| in the State if the installation, removal, replacement, |
11 |
| modification, or maintenance meets all of the following |
12 |
| requirements: |
13 |
| (1) the public utility's facility is located in an area |
14 |
| designated for economic redevelopment by a unit of local |
15 |
| government; |
16 |
| (2) the public utility's facility is located in an area |
17 |
| subject to tax increment financing; |
18 |
| (3) the public utility's facility is in an area that |
19 |
| qualifies as a transit-oriented development; and |
20 |
| (4) the public utility's facility is located in an area |
21 |
| that can be redeveloped in a manner that combats urban |
22 |
| sprawl.
