Amends the General Not For Profit Corporation Act of 1986. Requires a not-for-profit corporation that is excluded from the definition of "nonprofit organization" under the Unemployment Insurance Act because it does not have in employment 4 or more individuals within each of 20 or more calendar weeks to provide a written notice to each employee and each member of the board of directors that the employees of the not-for-profit corporation are not eligible to receive unemployment insurance benefits on the basis of their employment for the not-for-profit corporation.

| AN ACT concerning not-for-profit corporations.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The General Not For Profit Corporation Act of |
5 |
| 1986 is amended by adding Section 103.35 as follows: |

| (805 ILCS 105/103.35 new) |

| Sec. 103.35. Unemployment insurance; notice. A |
8 |
| not-for-profit corporation that is excluded from the |
9 |
| definition of "nonprofit organization" under Section 211.2 of |
10 |
| the Unemployment Insurance Act because it does not have in |
11 |
| employment 4 or more individuals within each of 20 or more |
12 |
| calendar weeks must provide a written notice to each employee, |
13 |
| either in each employee's employment contract or in a written |
14 |
| notice provided to employees who do not have employment |
15 |
| contracts, and to each member of the board of directors that |
16 |
| the employees of the not-for-profit corporation are not |
17 |
| eligible to receive unemployment insurance benefits on the |
18 |
| basis of their employment for the not-for-profit corporation.
