| AN ACT concerning courts.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Clerks of Courts Act is amended by adding |
| 5 |
| Section 12.1 as follows:
|

| Sec. 12.1. Electronic notice. The circuit clerk may provide |
| 8 |
| notice to a party by hard copy or by electronic notice, |
| 9 |
| pursuant to a uniform and standard policy adopted by the |
| 10 |
| circuit clerk. A recipient may elect to receive notices by hard |
| 11 |
| copy or electronically via the electronic address he or she has |
| 12 |
| registered with the circuit clerk. The clerk must provide |
| 13 |
| notice in the format chosen by the recipient. When providing |
| 14 |
| notice electronically, the circuit clerk shall maintain a copy |
| 15 |
| of the electronic content and a delivery receipt as part of the |
| 16 |
| records of his or her office. Administrative communications of |
| 17 |
| either the clerk or the court are not subject to the electronic |
| 18 |
| notice requirements. If all policies and statutes are complied |
| 19 |
| with, electronic notices shall have the same effect as hard |
| 20 |
| copy notices.

| Section 99. Effective date. This Act takes effect upon |
| 22 |
| becoming law.
