| 1 | AMENDMENT TO HOUSE BILL 5413

| 2 | AMENDMENT NO. ______. Amend House Bill 5413 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Code of Criminal Procedure of 1963 is | ||||||
| 5 | amended by adding Section 111-2.5 as follows: | ||||||
| 6 | (725 ILCS 5/111-2.5 new) | ||||||
| 7 | Sec. 111-2.5. State's Attorney; homicide; domestic | ||||||
| 8 | violence. The State's Attorney may not charge a person with | ||||||
| 9 | first degree murder, second degree murder, involuntary | ||||||
| 10 | manslaughter, reckless homicide, or drug-induced homicide if | ||||||
| 11 | the person killed had a documented history or pattern of | ||||||
| 12 | physically abusing the person who committed the homicide and | ||||||
| 13 | both the person who committed the homicide and the person | ||||||
| 14 | killed were, at the time of the offense or previously, family | ||||||
| 15 | or household members as defined in the Illinois Domestic | ||||||
| 16 | Violence Act of 1986.".
