SYNOPSIS AS INTRODUCED:

    Amends the Illinois Identification Card Act, Vital Records Act, and Illinois Vehicle Code to provide that if a military veteran who is currently participating in a skills training, rehabilitation, or employment program that is either operated by a State agency or operated by a non-State organization that is currently receiving grant funds from the State for the purposes of the program makes a written request or application for a copy or a certified copy of a birth certificate, a driver's license or the renewal of a driver's license, or an identification card, then the military veteran shall not be charged any fee for such request or application. Provides that the Secretary of State in consultation with the Department of Public Health shall develop rules to implement the provisions concerning fee waivers for military veterans participating in skills training programs. Contains a nonacceleration clause.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Identification Card Act is amended
5 by changing Section 12 as follows:

20     All fees collected under this Act shall be paid into the
21 Road Fund of the State treasury, except that the following
22 amounts shall be paid into the General Revenue Fund: (i) 80% of
23 the fee for an original, renewal, or duplicate Illinois
24 Identification Card issued on or after January 1, 2005; and
25 (ii) 80% of the fee for a corrected Illinois Identification
26 Card issued on or after January 1, 2005.

1     Any disabled person making an application for a standard
2 Illinois Identification Card for no fee must, along with the
3 application, submit an affirmation by the applicant on a form
4 to be provided by the Secretary of State, attesting that such
5 person is a disabled person as defined in Section 4A of this
6 Act.
7     An individual, who resides in a veterans home or veterans
8 hospital operated by the state or federal government, who makes
9 an application for an Illinois Identification Card to be issued
10 at no fee, must submit, along with the application, an
11 affirmation by the applicant on a form provided by the
12 Secretary of State, that such person resides in a veterans home
13 or veterans hospital operated by the state or federal
14 government.
15     Pursuant to Section 30 of the Vital Records Act, if a
16 military veteran who is currently participating in a skills
17 training, rehabilitation, or employment program that is either
18 operated by a State agency or operated by a non-State
19 organization that is currently receiving grant funds from the
20 State for the purposes of the program makes a written request
21 or application for an identification card, then the military

8     The application of a homeless individual for an Illinois
9 Identification Card to be issued at no fee must be accompanied
10 by an affirmation by a qualified person, as defined in Section
11 4C of this Act, on a form provided by the Secretary of State,
12 that the applicant is currently homeless as defined in Section
13 1A of this Act.
14     Pursuant to Section 30 of the Vital Records Act, if a
15 military veteran who is currently participating in a skills
16 training, rehabilitation, or employment program that is either
17 operated by a State agency or operated by a non-State
18 organization that is currently receiving grant funds from the
19 State for the purposes of the program makes a written request
20 or application for an identification card, then the military
21 veteran shall not be charged any fee for such request or
22 application. The Secretary of State, in consultation with the
23 Department of Public Health, shall develop rules to implement
24 the provisions of this Section.

1     Section 10. The Vital Records Act is amended by adding
2 Section 30 as follows:
 
3     (410 ILCS 535/30 new)
4     Sec. 30. Veterans; fee waiver. Notwithstanding any
5 provision of law to the contrary, if a military veteran who is
6 currently participating in a skills training, rehabilitation,
7 or employment program that is either operated by a State agency
8 or operated by a non-State organization that is currently
9 receiving grant funds from the State for the purposes of the
10 program makes a written request or application for a copy or a
11 certified copy of a birth certificate, a driver's license or
12 the renewal of a driver's license pursuant to the Illinois
13 Vehicle Code, or an identification card pursuant to the
14 Illinois Identification Card Act, then the military veteran
15 shall not be charged any fee for such request or application.
16 For the purposes of the fee waivers under this Section,
17 "military veteran" means an Illinois resident who has served as
18 a member of the United States Armed Forces, a member of the
19 Illinois National Guard, or a member of the United States
20 Reserve Forces. The Department, in cooperation with the
21 Secretary of State, shall develop rules to implement the
22 provisions of this Section.
 
23     Section 15. The Illinois Vehicle Code is amended by
24 changing Section 6-118 as follows:

25         Administrators network Trust Fund);

23     In order to ensure the proper implementation of the Uniform
24 Commercial Driver License Act, Article V of this Chapter, the
25 Secretary of State is empowered to pro-rate the $24 fee for the
26 commercial driver's license proportionate to the expiration

1 date of the applicant's Illinois driver's license.
2     The fee for any duplicate license or permit shall be waived
3 for any person age 60 or older who presents the Secretary of
4 State's office with a police report showing that his license or
5 permit was stolen.
6     No additional fee shall be charged for a driver's license,
7 or for a commercial driver's license, when issued to the holder
8 of an instruction permit for the same classification or type of
9 license who becomes eligible for such license.
10     (b) Any person whose license or privilege to operate a
11 motor vehicle in this State has been suspended or revoked under
12 Section 3-707, any provision of Chapter 6, Chapter 11, or
13 Section 7-205, 7-303, or 7-702 of the Family Financial
14 Responsibility Law of this Code, shall in addition to any other
15 fees required by this Code, pay a reinstatement fee as follows:
16     Suspension under Section 3-707..................... $100
17     Summary suspension under Section 11-501.1...........$250
18     Other suspension.....................................$70
19     Revocation..........................................$500
20     However, any person whose license or privilege to operate a
21 motor vehicle in this State has been suspended or revoked for a
22 second or subsequent time for a violation of Section 11-501 or
23 11-501.1 of this Code or a similar provision of a local
24 ordinance or a similar out-of-state offense or Section 9-3 of
25 the Criminal Code of 1961 and each suspension or revocation was
26 for a violation of Section 11-501 or 11-501.1 of this Code or a

1 similar provision of a local ordinance or a similar
2 out-of-state offense or Section 9-3 of the Criminal Code of
3 1961 shall pay, in addition to any other fees required by this
4 Code, a reinstatement fee as follows:
5     Summary suspension under Section 11-501.1...........$500
6     Revocation..........................................$500
7     (c) All fees collected under the provisions of this Chapter
8 6 shall be paid into the Road Fund in the State Treasury except
9 as follows:
10         1. The following amounts shall be paid into the Driver
11     Education Fund:
12             (A) $16 of the $20 fee for an original driver's
13         instruction permit;
14             (B) $5 of the $30 fee for an original driver's
15         license;
16             (C) $5 of the $30 fee for a 4 year renewal driver's
17         license;
18             (D) $4 of the $8 fee for a restricted driving
19         permit; and
20             (E) $4 of the $8 fee for a monitoring device
21         driving permit.
22         2. $30 of the $250 fee for reinstatement of a license
23     summarily suspended under Section 11-501.1 shall be
24     deposited into the Drunk and Drugged Driving Prevention
25     Fund. However, for a person whose license or privilege to
26     operate a motor vehicle in this State has been suspended or

1     revoked for a second or subsequent time for a violation of
2     Section 11-501 or 11-501.1 of this Code or Section 9-3 of
3     the Criminal Code of 1961, $190 of the $500 fee for
4     reinstatement of a license summarily suspended under
5     Section 11-501.1, and $190 of the $500 fee for
6     reinstatement of a revoked license shall be deposited into
7     the Drunk and Drugged Driving Prevention Fund.
8         3. $6 of such original or renewal fee for a commercial
9     driver's license and $6 of the commercial driver
10     instruction permit fee when such permit is issued to any
11     person holding a valid Illinois driver's license, shall be
12     paid into the CDLIS/AAMVAnet Trust Fund.
13         4. $30 of the $70 fee for reinstatement of a license
14     suspended under the Family Financial Responsibility Law
15     shall be paid into the Family Responsibility Fund.
16         5. The $5 fee for each original or renewal M or L
17     endorsement shall be deposited into the Cycle Rider Safety
18     Training Fund.
19         6. $20 of any original or renewal fee for a commercial
20     driver's license or commercial driver instruction permit
21     shall be paid into the Motor Carrier Safety Inspection
22     Fund.
23         7. The following amounts shall be paid into the General
24     Revenue Fund:
25             (A) $190 of the $250 reinstatement fee for a
26         summary suspension under Section 11-501.1;

1             (B) $40 of the $70 reinstatement fee for any other
2         suspension provided in subsection (b) of this Section;
3         and
4             (C) $440 of the $500 reinstatement fee for a first
5         offense revocation and $310 of the $500 reinstatement
6         fee for a second or subsequent revocation.
7     (d) All of the proceeds of the additional fees imposed by
8 this amendatory Act of the 96th General Assembly shall be
9 deposited into the Capital Projects Fund.
10     (e) The additional fees imposed by this amendatory Act of
11 the 96th General Assembly shall become effective 90 days after
12 becoming law.
13     (f) Pursuant to Section 30 of the Vital Records Act, if a
14 military veteran who is currently participating in a skills
15 training, rehabilitation, or employment program that is either
16 operated by a State agency or operated by a non-State
17 organization that is currently receiving grant funds from the
18 State for the purposes of the program makes a written request
19 or application for a driver's license or the renewal of a
20 driver's license, then the military veteran shall not be
21 charged any fee for such request or application. The Secretary
22 of State, in consultation with the Department of Public Health,
23 shall develop rules to implement the provisions of this
24 subsection.
