AMENDMENT TO HOUSE BILL 5688

2     AMENDMENT NO. ______. Amend House Bill 5688 as follows:
 
3 on page 29, by replacing lines 19 through 26 with the
4 following:
5     "(y) Beginning on the effective date of this amendatory Act
6 of the 96th General Assembly, a child with a disability who
7 receives residential and educational services from the
8 Department shall be eligible to receive transition services in
9 accordance with Article 14 of the School Code from the age of
10 14.5 through age 21, inclusive, notwithstanding the child's
11 residential services arrangement. For purposes of this
12 subsection, "child with a disability" means a child with a
13 disability as defined by the federal Individuals with
14 Disabilities Education Improvement Act of 2004."; and
 
15 on page 30, by deleting lines 1 through 12; and

1 on page 30, by replacing lines 22 through 24 with the
2 following:
3 "disabilities. A child with a disability who receives
4 residential and educational services directly from or paid by
5 the Department shall be eligible to receive transition services
6 in accordance with Article 14 of the School Code from the age
7 of 14.5 through age 21, inclusive, notwithstanding the child's
8 residential services arrangement. Beginning on the effective
9 date of this amendatory Act of the 96th General Assembly, the
10 Department shall review its policies and regulations that
11 create obstacles to the provision of these services and within
12 the constraint of existing federal or State law change or
13 modify the policies and regulations to support the provision of
14 transition services in accordance with Article 14 of the School
15 Code. For the purposes of this Section, "child with a
16 disability" means a child with a disability as defined by the
17 federal Individuals with Disabilities Education Improvement
18 Act of 2004."; and
 
19 on page 31, by deleting lines 1 through 17.
