Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act for a valet service provider to refuse a consumer's request to store his or her motor vehicle overnight when the consumer indicates that he or she is too intoxicated to safely drive the motor vehicle. Provides that the valet service shall store the consumer's motor vehicle until 12:00 p.m. of the following day and may charge a fee of not more than $30 for the additional storage of the consumer's motor vehicle.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Consumer Fraud and Deceptive Business |
5 |
| Practices Act is amended by adding Section 2III as follows: |

| (815 ILCS 505/2III new) |

| Sec. 2III. Valet service provider. |
8 |
| (a) As used in this Section: |
9 |
| "Motor vehicle" has the meaning attributed to that term by |
10 |
| the Illinois Vehicle Code. |
11 |
| "Short-term" means a period of time lasting not more than 6 |
12 |
| hours. |
13 |
| "Valet service provider" means a person who provides a |
14 |
| short-term parking and storage service of a consumer's motor |
15 |
| vehicle whereby a consumer typically leaves a motor vehicle at |
16 |
| the entrance of a business or event and an attendant parks and |
17 |
| retrieves the motor vehicle. |

| (b) A valet service provider may not refuse a consumer's |
19 |
| request to store his or her motor vehicle overnight when the |
20 |
| consumer indicates that he or she is too intoxicated to safely |
21 |
| drive the motor vehicle. If a valet service provider accepts |
22 |
| the consumer's request under this subsection, the valet service |
23 |
| shall store the consumer's motor vehicle until 12:00 p.m. of |
