AMENDMENT TO HOUSE BILL 5879

    AMENDMENT NO. ______. Amend House Bill 5879 by replacing

everything after the enacting clause with the following:

    "Section 5. The Public Utilities Act is amended  by adding 
5
Section 8-515 as follows:

    (220 ILCS 5/8-515 new)
7
    Sec. 8-515. Proof of identification before starting  
8
service; account in minor's name prohibited. The Commission 
9
shall require (1) that an electric or gas utility must 
10
positively identify a prospective customer's identity and, if 
11
the identity cannot be satisfactorily confirmed, require 2 
12
forms  of identification before it starts service to that person 
13
and (2) that the account of a customer may not be in the name of 
14
a person who is under 18 years of age, unless the person is an 
15
emancipated minor.

    Electric and gas utilities may obtain from customers who

have not been positively identified 2 forms of identification 
2
from the following list: (i) a social security number, (ii) a 
3
driver's license number and state of issuance, (iii) a state 
4
identification card, (iv) a passport, (v) a birth certificate, 
5
(vi) immigration and naturalization documents, (vii) a tax 
6
identification number, (viii) a business license, (ix) 
7
articles of incorporation, or (x) another valid 
8
government-issued photo identification.

    Section 99. Effective date. This Act takes effect July 1, 
10
2010".
