Amends the Good Samaritan Act. Provides that any person, who is not an emergency responder, who in good faith provides care or assistance at the scene of an emergency without fee or compensation to any person shall not, as a result of his or her act or omissions, except willful and wanton misconduct on the part of the person in providing the care or assistance, be liable to a person to whom such care or assistance is provided for civil damages. Effective immediately.

| AN ACT concerning civil law.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Good Samaritan Act is amended by adding |
5 |
| Section 71 as follows: |
6 |
| (745 ILCS 49/71 new) |
7 |
| Sec. 71. Exemption from civil liability for emergency care |
8 |
| or assistance. Any person, other than a person specified in |
9 |
| Section 70 of this Act, who in good faith provides care or |
10 |
| assistance at the scene of an emergency without fee or |
11 |
| compensation to any person shall not, as a result of his or her |
12 |
| act or omissions, except willful and wanton misconduct on the |
13 |
| part of the person in providing the care or assistance, be |
14 |
| liable to a person to whom such care or assistance is provided |
15 |
| for civil damages.

| Section 99. Effective date. This Act takes effect upon |
17 |
| becoming law.
